Jury trial. They decided based on the facts presented by the states attorney. It would be interesting to get them to post the complete story here.

What charges were presented?
  • Homicide with an automobile while under the influence (2)
  • Homicide with a motor vehicle while impaired by alcohol
  • Negligent manslaughter with an automobile
  • Exceeding the speed limit
  • Negligent driving
  • Attempting to drive while under the influence (2)
  • DUI
The jury ruled that Migliaccio was guilty of negligent driving and driving a vehicle on the highway while exceeding the speed limit. Not guilty on all others.

I know thats what he was charged with initally. I also know that the SA can decide not to present some charges as a result of plea deals. That's why I asked.

Do you REALLY BELIEVE that you or I would get that same "slap on the wrist" for those same charges???

He skated on ALL of the FELONY charges and only was found guilty on TRAFFIC charges. This will allow him
to once again put on a badge, carry a gun and "mete out 'justice' " to the likes of us common folk. They take
care of their own.

Well, he had Bob Bonsib - one of the best attorneys in MD.

Blood alcohol content / evidence was not allowed/admitted ...of course the jury found him not guilty on all those charges!!!

Especially since he was allowed to resign rather than be fired.

Judge and Jury can only act on what was presented to them, and from the sounds of it, a lot wasn't presented due to improper procedures after the accident. Incidents like this do not help community/LEO relations.
Exactly. I will probably be changing who I vote for sheriff this year, as a result of this

The very nature of this case's verdict now makes it political anyway, as it is so close to the Primary. Sorry, Ricky - but what you say below is also politicizing it.
For example, I have seen people say I did this or that on the day of the accident. For the record I was in Florida and had nothing to do with it that day, or the investigation processes that followed.
He made sure to exonerate himself as having nothing to do with this case at all.
I cannot get into the specifics of the accident itself.
Within minutes of this accident there were several deputies on the scene, to include the second in command.
But he got into specifics and made it political by saying the Second in Command was there.

However, I glad he did, because now I am certain to be changing my vote.

I'm betting McDowell, the assistant sheriff, had a hand in this outrageous outcome as well. Being Evans' hand picked sidekick and all.
