Calvert Officer Who Was Charged In Fatal 2019 Accident

I just saw this statement on the matter from Sheriff Evans:

“First and foremost, my continued prayers and condolences go out to the family of Leah Clark, who was struck and killed on Oct. 29, 2019. This case involved an off-duty deputy sheriff who was allegedly drinking and driving.
“A trial concluded on March 18, 2022 and in my opinion, justice was NOT served.
I believe if the alcohol tests had not been suppressed by the judge, the results of this trial may have been different.
“At the scene, I requested the Maryland State Police to handle the possible criminal investigation (DUI) and they agreed to do so.
“The Calvert County Sheriff’s Office conducted the crash reconstruction investigation on scene. In the future, in this type of incident, we will request Maryland State Police to conduct the entire investigation.
“Again, my sincere condolences go out to Leah’s son Lyric, fiancé Terry ‘Tbo’ Butler and parents Fran and Justin.
“In closing, there is no further information I can provide due to pending litigation.”

I must say that I have a new-found respect for Evans, or did I miss a key part of the story? What's with this judge? Is he one of the 'cops can do no wrong' people that seek to excuse any and all bad behavior? I have not followed this story closely, so entirely possible I missed the underlying theme.

That statement from Evans is hollow, at BEST. (I also posted it earlier in this thread) I say this as a former very strong supporter of Evans for all these years. However, this one case has completely changed my opinion of him. I've been at meetings where he's been asked questions about this case and he's been avoiding those public questions that have been asked of him for the past 2 years due to the pending case. Fair enough. I get it. I have heard the rumors over and over about the "good old boy network". I'm not naïve, I know it happens, but this is even beyond that type of thing. This is outright corruption.

There are quite a few very fishy goings on that happened that night. From the time of the accident, during the time that the Off-Duty Police Officer was "taken" from the accident scene and then later at the CCSO waiting on the MSP to get there. There were Deputies of varying ranks there at CCSO, WHO KNOW FULL WELL HOW TO EXECUTE A PROPER SEARCH WARRANT, or make sure someone's Constitutional rights are protected. There is no way they "botch" this crap up accidentally. It's like the Keystone Cops, for crying out loud.

There are a few public posts on FB that are included in a FB page that include transcripts about that timeframe, as well.







Those are supposed transcripts from the hearing where the Judge "threw out", disallowed or whatever the legal term is. The MSP, CCSO (supposedly Evans said MSP should take this over, and he was out of town) but supposedly the 2nd in Command (McDowell) and even Steve Jones were both present that night AT CCSO where this Off-Duty Police Officer waited for the MSP to get there. (MSP is not even 5 minutes away from CCSO)

According to what I've read (and some of the parties in court that I've talked to) the Judge had no choice but to throw that evidence out. The Off-Duty Police Officer was not read his Constitutional rights NOR DID THE CCSO OR MSP SECURE A WARRANT before the MSP drove him to and then forced/required him to submit to a blood test at Calvert Hospital. Additionally, the warrant could have been secured RIGHT AT THE CCSO.

So the Judge said this evidence is not allowed. Of course a jury cannot convict a man with no evidence presented to them.

CCSO is laying this on the MSP. I guess that will remain to be seen. As far as I know- MSP has made no public statement about this case. They probably won't comment on the details because there is obviously more pending (Civil) litigation.

If that's a Stutz Bearcat, my favorite model from 1914 went for $325,000 according to Hemmings about 15 years ago.
