Can they take your dog if it bites somebody in its own yard

Our friends dog nipped at a kid leaving a very small scratch. The dog was on its own porch and in my opinion was protecting its owners and its puppies that they kids had out. Their new puppies that litterally just opened their eyes. Anyway today the kids mom went back to talk to the owner and when she opened the door I guess the mother dog got out and scared the lady she says it bit her but other people say it didn't. Anyway apparently animal control took the mother dog and all of her puppies I don't think that is right since the dog was in its own yard. I feel so bad for my friend and she will have to tell her kids when they get home from school it just doesn't seem fair since the dog wasn't running lose. Whats your opinion?

If the dog is on the porch and you approach it of your own volition, I think it's your problem if you get nipped. If you ring someone's doorbell and, when they answer it, their dog attacks you, that should be their problem for not restraining Cujo before they opened the door.

I wonder if it's a precaution against rabies? I know when my sister's dog nipped at a kid,(who was told "don't pet him, he will bite" :duh: ) animal control came and put him on lock-up for a week or so. :shrug:

Lactating females are very territorial, and the owners should have had her restrained. Biting dogs are not acceptable.

The mom is with her pups. Hopefully all can be resolved, and a lesson learned.

We had a wonderful austrailian shepherd, (Kip, the Amazing Wonderdog), who had puppies in the garage. A kid in the neighborhood came through a dog pen (opened the gate), came through the garage door and went in the garage. The dog bit her because she was protecting her pups. We had told the kid NOT to go in there, ever, unless we were with her, but he did it on his own. His grandma called the cops. They made us keep her confined for two weeks in the garage and said there was nothing we could do about the kid trespassing. A few months later, she "nipped" at the heal of a jogger (her tendency was to "herd" people into our yard or keep them in the yard :lmao:). Cops came again and again we had to keep her confined for two weeks. We had to give her away after that because the cops said the third time they would take her away from us. She's having fun on a farm in Calvert now......

I had a pitt bull years ago who bit another dog in my yard. Now these dogs played together all the time. The dog, a female, would jump my fence to play with Chopper. A play session got a little rough, Roxanne bit Chops and Chops bit back. Nothing major. But the people rushed her to the vet, where they cleaned and dressed the little bite wound. Roxannes owners then sued ME for the measly 100 dollar vet bill. ( Which I would have gladly and neighborly helped pay had they asked nicely.)

To make a long story short, I didn't even get to open my mouth in court. The judge called me a irresponsible pitt bull owner ( WTF, this dog was in MY yard!) and ordered me to pay. When I tried to talk he PUT HIS HAND UP. :burning: I walked directly to the clerks office filed for appeal. They soon dropped it.

I adopted a nipper a couple years ago. She has never nipped and any of us, her family, but she is very territorial to anyone new that happens to "show up". It is my responsibility to know where she is at all times in case anyone happens to drop by and to make sure she is sent to her "beddy bye" before I open the door should anyone happen to knock.

There was no puncture wound only a raised red mark on the child’s skin. All we had to do was show evidence that our dogs’ vaccines were current and provide the police with our vets name and phone number. There was never any talk of taking the dog.

WTF is up with people? :burning: I swear to God I'm walling up my property so as to never have to deal with some stupid parent who's never taught their child how to act around a dog. My oldest dog is mental, and grumpy. He does not like children, hell, he doesn't like most people. I'm sorry, I'm not getting rid of my dog because someone is too retarded stay away from him in HIS house. I'm sure some day I'll be sued. :duh:

Not just Maryland...
My nephew had a friend over, who is a known trouble-maker, and he was mistreating (pulling fur!) my brother's dog. The dog nipped the kid (no broken skin...), the parents' sued, homeowner's insurance paid and told my brother to get rid of his dog. :war:

Anytime there is a dog bite, the dog must be held in "quarantine" for 10 days. After which, it can be returned or destroyed. She may be fined. It's kinda funny animal control took the dog since they do not have a "quarantine" facility. They either take them to Hughesville Animal Shelter or sometimes quarantine them at a local kennel. One of the ones I was told they use is Paradise Kennels. That is what they have told me in the past. They told me it is up to the owner to quarantine the animal. I would take the rabies/shot records to the animal control officer and explain the situation. They know that mother dogs can sometimes be very protective of their pups. I'm surprised that they took her knowing that. As for the neighbors, NO TRESPASSING signs are sold all around the county. I would definately invest in some and personally give the woman and her child a written notice not to trespass.

With my Rotti, I was told I have to put BEWARE OF DOG signs like EVERYWHERE.... I have 2 friggin acres.. Im not buying 100 signs to put around my property.... but what my insurance company told me, was that I have to have 1 on each door which is used for most entrance and exit, and 1 somewhere to alert people coming up my driveway, and they said put one every so often around the yard.... so I have like, 4-5 signs now, but Im going to buy 2 or 3 more to put on the back side of my property....

But, what the insurance people told me, was that if you have these signs in obvious, visible places, ANY person(s) that comes in my yard, are at their own risk, they cannot sue, or call animal control if they are in MY YARD....

When I was a kid, we had a medium-sized shepherd mix. The neighbor kids tormented it by slapping their coats at his face while he was at the end of his run - on our property. One day, one of those kids got too close to him, and he knocked him down and bit him. The kid wasn't seriously injured - but the dog had to be destroyed. I was only eight at the time, but it STILL bothers me that the DOG was put down for doing what any animal would have done if it was tormented daily.
