LAWFARE: Judge John McConnell has been on the board of a federally funded NGO since 2006. Are federal judges allowed to be on the boards of NGOs? Can they preside over cases that impact the funding of their NGOs?

LAWFARE: Another federal judge has intervened to block President Trump from using his Article II powers. This time Judge Carl J. Nichols has ruled that Trump cannot bring overseas foreign-service officers back to the US. He was the judge in Steven Bannon and Sidney Powell's trials.

Judge Carl J. Nichols is the latest federal judge to block the president from exercising his Article II powers. He previously presided over Steve Bannon’s case as well as Sidney Powell’s.

@realchrisrufo's NSA whistleblower explains how, starting in the Obama years, the NSA swerved from being an intelligence agency to full-time DEI. Employees were hired who never did any work except attending DEI meetings. Real employees were given the message that participating in DEI nonsense was the key to getting promoted. Analysts would refuse to provide information on American adversaries who were transgender, because it would require using their "deadname."

Outrageous. The agency needs to be rebooted from the ground up.

Pentagon spent millions injecting DEI into science and medicine

“Research and development spending in the Department of Defense contains large sums of money being spent on non-defense spending, ‘centers of excellence’ sponsored as pork spending by congressmen never requested by the Pentagon, and politicized initiatives like DEI and climate change,” Wilson Beaver, Heritage Foundation national security policy adviser, told the Washington Examiner. “This sort of spending needs to be cut and reallocated into the procurement of weapons systems like ships, planes, and munitions that our troops need to protect the national security interests of the United States.”

So far, the Department of Government Efficiency’s cuts to the Pentagon have been limited to a handful of contracts funding diversity training and subscriptions to information services such as Politico Pro and Westlaw.

The largest single STEM DEI item funded by the Pentagon was the Inclusive Cancer Care Research Equity for Black Men Consortium, a group of universities and health organizations that have received over $10 million in military funding since 2022 to optimize prostate cancer treatment, specifically for black men.

Yesterday, the BBC ran a very encouraging story headlined, “Trump foreign aid freeze to stay for now, US Supreme Court chief rules.” Brand-new US District Judge Amir Ali, 39, the country’s first Muslim-Canadian federal judge (dual citizen), had issued a TRO ordering President Trump to release about $2 billion worth of frozen payments to USAID regime-change contractors by midnight on Wednesday. They thought Ethiopian LGBTQ+ puppet shows were back on the billings. But no.

image 7.png

As yesterday’s midnight deadline approached, the Trump administration appealed to the Supreme Court, arguing it would be impossible to process claims in any orderly fashion in such a short period of time. The Court responded promptly. Chief Justice Robert’s short order said Judge Ali’s commands to unfreeze USAID were “stayed pending further order of the undersigned or of the Court.”

A couple legal points are worth noting. First, the Trump team first tried to appeal to the DC Circuit, which refused to hear the issue. So this Supreme Court slapdown is even more humiliating to the DC Circuit than to Judge Ali, assuming the Circuit is capable of embarrassment at this point. Second, the USAID payments sit at the intersection of peak Executive Power, since the President controls not just the Executive Branch, but has sole authority over foreign relations.

The primary plaintiff, the AIDS Vaccine Advocacy Coalition, was probably picked because it (allegedly) relates to AIDS, a scary subject that makes for a good sound bite. But it might not have been the best pick. The Coalition’s most recent non-profit disclosure form (called a ‘990’), shows that out of a $14 million taxpayer-funded budget, over $9 million paid the salaries and expenses of the Coalition’s managers and employees. In other words, it’s ripe for an audit.

But Justice Robert’s order was possibly even better. Its second sentence set a deadline for responses by tomorrow at noon. Which means the Supreme Court is taking hold of the case. They’re not risking Judge Ali issuing any more diktats inviting a Constitutional showdown.

Thus, thanks to Judge Ali’s wild overreach, this case has all the makings of a landmark ruling on executive power. If the Court goes beyond just issuing a temporary stay—perhaps delivering a definitive smackdown—it could set precedent limiting future attempts by activist judges to hijack executive policy through the courts. Given that tomorrow’s deadline suggests an expedited review, we might not have to wait long to see how this plays out.

I told you about those TROs.

ASTROTURF: The fake outrage at DOGE at GOP townhalls is being coordinated by a Soros-backed NGO called Indivisible. President Trump and his DOGE efforts are overwhelmingly popular among Republicans and Independents. Even a majority of Democrats approve of the cost cutting.

The couple behind Indivisible's anti-DOGE agitation operation—targeting GOP townhalls and flooding congressional phone lines—are Leah Greenberg and Ezra Levin. Their war chest stands at $11.7 million, bolstered by $7.26 million from Soros.

Judge Orders DOGE Employee to Answer Questions Under Oath

Unions and other groups have lodged a slew of lawsuits against DOGE and government agencies working with the cost-cutting advisory body. A judge in one of the cases recently blocked the U.S. Department of Education and the Office of Personnel Management from sharing sensitive data with DOGE, concluding that the privacy rights of plaintiff members would be violated absent a restraining order.

Bates previously declined a request in the AFL-CIO case for a temporary restraining order, finding that the unions did not show they were substantially likely to succeed in their claims. He is weighing whether to grant a preliminary injunction, which would prevent DOGE from accessing the systems while the case goes on.

Bates said on Thursday he was granting the request for expedited discovery because “it is necessary to determine the contours of the agency actions that plaintiffs challenge.”

A California district judge granted partial relief to some of the federal government’s recently terminated probationary employees who argued that their termination from various agencies was unlawfully ordered by the Office of Personnel Management (OPM) under the false cause of performance.

Senior District Judge William Alsup provided partial relief on Feb. 27 to the non-union organizational employees, ordering their immediate reinstatement to agencies including the National Parks Service, every agency within the Department of Veterans Affairs, the Bureau of Land Management, the Small Business Bureau, and the Department of Defense.

He also ordered that OPM’s request be stopped and rescinded, because of the possibility of more federal employees being let go under the request.

All union-representative employees who were terminated, he ruled, had to go through administrative processes like the Merit Systems Protection Board (MSPB) and the National Labor Relations Authority (NLRA).

Eight attorneys were present in the San Fransisco courtroom representing 10 union and non-union organizations, which were, in turn, representing hundreds of probationary employees who said their termination at their respective agencies came down as a direct order from Charles Ezell, acting head of OPM rather than lawful independent action with cause from their agency head.

Ex-SecDefs Revolt: Mattis, Austin, and Three Others Demand Senate Block President Trump’s Joint Chiefs Chairman Nominee Over Firing of CQ Brown, Call for Investigations

Five former secretaries of Defense have signed a letter protesting the firing by President Trump of Chairman of the Joint Chiefs of Staff Gen. C. Q. Brown, demanding the Senate refuse to confirm Trump’s nominee to replace Brown and for Congress to investigate the firing of Brown and other senior officers by Trump.

Trump nominated retired Air Force Lieutenant General Dan “Razin” Caine to replace Brown. Caine will need a waiver from Trump on meeting the legal requirements for the chairman.

House Speaker Mike Johnson: Anti-GOP Town Hall Protesters ‘Paid’ by Democrats

“The videos you saw of the town halls were for paid protesters in many of those places,” Johnson said. “These are Democrats who went to the events early and filled up the seats.”

Collins said that Johnson could not “argue they were all paid protesters,” adding that a “Republican acknowledged they were his constituents.”

“One Republican acknowledged they were … constituents. That’s fantastic, OK, but they had Democrats come and fill the seats early, all right?” Johnson shot back. “This is an old playbook that they pulled out and ran, and it made it look like that what is happening in Washington is unpopular.”

NYPost: Thomas Crooks May Have Had Accomplice, FBI Stonewalling — Ignores Obvious Evidence from July of Accomplices, FBI Lies, Possible FBI Involvement

The New York Post is publishing what their reporter Dana Kennedy is falsely calling an exclusive, citing geofencing and data analysis that shows that alleged Trump assassin Thomas Crooks had an accomplice.

The New York Post is giving its readers an exclusive six months late to this aspect of the story, and without crediting the work done prior by others.

Crooks is alleged to have taken 8 shots at then-candidate Donald Trump at the Butler Farm Show grounds in Butler, Pennsylvania on July 13, 2024 from atop the AGR Building.

The NY Post cites the investigatory work of Private Investigator Doug Hagmann as having reviewed geofencing data, interviewed 100 people in the area and also receiving stonewalling from the FBI and other unnamed law enforcement.
