As part of the deal, one of the rules is that you can not discriminate based on whatever factors; race, religion, sexual orientation. They did not apply for a license based on the ability to be able to pick and choose who their clients are based on race and/or religion and/or sexual orientation.

This woman is not demanding that a pizza shop sell her car parts. She is not demanding that they marry her. She is not demanding that they like her, send her Christmas cards or be the Godfathers of her child. She is demanding that a sub shop sell subs, that a car parts store sell car parts, that an artificial insemination store sell artificial insemination.
What is the purpose of this license? Is it to provide oversight of how they perform their services? How does the state deciding who their customer base will be affect how well they perform their service?

Although I am not a supporter of homosexual rights, I did not say in this thread that the woman should not have gone elsewhere, to the contrary, I think that she should have taken the referral, and moved on.

blacks and jews should not be turned away simply because they are black or jew. A buddist should be turned away from a Christian establishment such as mentioned in the article. The Christian doctor is practicing his Christian responsibility to ensure the child will be brought up properly according to his beliefs. Not a wrong thing for him to do.

however, the buddist should not be turned away from establishments that do not involve religious reasons behind their motivation for business practice.

Blacks a jews are protected in the constitution, even if they are gay.
Buddists are protected in the constitution under the freedom of religion rights.
homosexuals do not find specific wording in the constitution to cover them against discrimination in cases like this.

the doctor had a right to turn her away in this instance.

I finally realized where your mistake is.

The limitations listed in the Constitution are not on the Citizens it is on Government. It limits what the Government can do.

In the spirit of the Constitution the Government can NOT deny anything unless it has a Basis. The Government is not allowed to Discriminate.

(1) There is no allowance in the Constitution that would allow the Government to ban Homo Marriage. As such any Ban is illegal because there is no basis in the Constitution that would allow it. The Constitution lists the activities of the federal government. Marriage is not among them. Therefore, per the tenth amendment, marriage is in the realm of the states and/or the people themselves.

(2) The Government isnt interfering with Religion, the Government is taking someone to task for discrimination. Should a Muslim owned business be allowed to discriminate against Jews? Yes Should a Baptist owned buisness be allowed to discriminate against Catholics? Yes

(3) Your repeating your Number 2, its still invalid based on the response to your Number 2

You might find this hard to believe, but I agree with you on this one. While I am a supporter of homosexual rights, I am an even greater supporter of personal rights. In your home or business you should be able to accept only who you want. If you don't like blacks, whites, jews, buddhist, etc... it should be your right to refuse them. The only group who I don't think gets this right is goverment bodies, they're composed of and supported by society as a whole and should service all of society equally. I wasn't going to post this because it kind of sounds like I'm supporting discrimination, I don't think I am, but if you do feel free to flame at will.

Oh I agree that this woman was more than likely just being a jerk and a bully but in general I do not think a person should be able to deny services because of their beliefs.
A person should not have the right to go beyond the responsibilities of their job to impose their morals or beliefs on others.
Like pharmacists for example. Their job is to dispense prescriptions. If the pharmacy has the drug on hand the pharmacist should have to dispense it whether they are Baptist and the drug is Plan B or if they are a Scientologist and the drug is Prozac.
Or a Muslim taxi driver refusing service because the blind client has a dog. If you cannot do your job without your beliefs interfering with it then quit and find something else.

How? If you do not like the job you were hired to do quit and get a new job. How is that forcing a pediatrician to perform abortions for example? Or a podiatrist to be involved in state executions?

she said that anyone offering said service should be obliged to actually provide the service.

i.e. I'm set up a lemonade stand to the public. Therefore I am obliged to sell lemonade to the public (not just whites, not just asians, not just lesbians, but to the public). I am not, however, required to sell grape juice, as that doesn't fall under my product catagory.

They feel that gay rights are much more important than any religious or business rights and made the law to force them to comply. This is about a state making laws to bascially take away one groups freedoms and give the power to another. IT'S NOT RIGHT. Don't give a crap if they're gay, or whatever. Why are they taking one persons rights away and giving more power to another's?? I thought this was still The United States of America not the United State of California.
