But look at post #9 from the link you provided.. she has to have a lawyer file a claim against HER insurance company and the uninsured motorist.

Not necessarily so. She will get her medical bills paid, etc. Lawyers generally take their percentage after costs are paid. I worked for PI laywers for a long time. She really needs to find out who owns the car, if the car was insured (and tags valid), who was driving the car, and what exactly her insurance (and uninsured motorist) covers.

She can contact the MVA's Uninsured Motorist Division to get information as to how to proceed or contact an attorney. Most attornyes will do a free consult.

Did you call the insurance company and this is how you found out they did not have insurance?

I am sure that the information you have also includes a phone number to the person who hit you. Call that and make sure the information is correct. Those numbers are entered in at the MVA office and often, they either get entered in wrong, called out to the officer wrong, they may have switched companies and forgot to notify MVA, or whatever. If they cannot provide you insurance information, call the officer. Not having insurance on a vehicle is a must appear offense, meaning they must appear in court and speak to the judge about the matter.

I am just trying to figure out how you came to the conclusion they have no insurance, because if you are going by the form the officer gave you, I can see problems with that. :confused:

My insurance company did a DMV trace on the tag and spoke with the guy who was DRIVING the car, he had to give his statement to my insurance company today. So I am in a lose of what to do, my insurance adjuster stated that the guy who was driving it was his girlfriends car and he isn't sure if she had insurance.

You shouldn't have to do anything. Your insurance company should take care of it.

Where do you live? Which county?

Something doesn't seem right. His girlfriend was with him, correct? All of this should have come out at the time of the accident report and there had to be an accident report done because you were transported from the scene.

Yep. But, all of the information should have been obtained at the scene and driver, etc. ticketed.

I'm supried that he didn't leave in chrome bracelets if he couldn't show proof of insurance at the scene of an accident with injuries

After reading her posts..and said the cop made out the paper from the information her husband gave him...Is it possible she is saying she was in an accident that sent her and kids to the hospital and did not call a cop to the scene? Sounds like they did a report afterward..I hope not.

The cop did the report on the scene, he came into the ambulance & talked to me. NOW whetther the POLICE ran the plates to ENSURE they were valid, i don't know. THe cop told my husband that the driver (24YO) would be charged in the accident.

They gave the cop an inusrance company name and a "policy #" but once out of the hospital and when I called the "insurance" company they provided they informed me that the policy # was not a valid policy # and they didn't have anything under the owners name (the 19YO girl)

In Maryland, MAIF (Maryland Automobile Insurance Fund) provides both insurance coverage to people who can't get it otherwise and they also provide compensation (up to $20,000) for people struck by uninsured drivers.

Not a very well known fact, but I'm a paralegal and work in PI matters daily. You need to contact MAIF (in Annapolis) and submit a claim for damages. They will in turn contact the uninsured driver and get a judgment for restitution through the court system.

I was injured, back was thrown out and am home on bedrest.

I am out of work for a month and have to have someone at home with me at all times, I have a 18mth old to take care of.



Hey you looked ok today at the football game!!! Not bad for someone who is on bedrest and out of work for a month.

Md has uninsured motorist coverage.
