Lawsuit Over Brokeback Mountain in Class

CHICAGO - A girl and her grandparents have sued the Chicago Board of Education, alleging that a substitute teacher showed the R-rated film "Brokeback Mountain" in class.

The lawsuit claims that Jessica Turner, 12, suffered psychological distress after viewing the movie in her 8th grade class at Ashburn Community Elementary School last year.

The film, which won three Oscars, depicts two cowboys who conceal their homosexual affair.

Turner and her grandparents, Kenneth and LaVerne Richardson, are seeking around $500,000 in damages.

"It is very important to me that my children not be exposed to this," said Kenneth Richardson, Turner's guardian. "The teacher knew she was not supposed to do this."

According to the lawsuit filed Friday in Cook County Circuit Court, the video was shown without permission from the students' parents and guardians.

The lawsuit also names Ashburn Principal Jewel Diaz and a substitute teacher, referred to as "Ms. Buford."

The substitute asked a student to shut the classroom door at the West Side school, saying: "What happens in Ms. Buford's class stays in Ms. Buford's class," according to the lawsuit.

Richardson said his granddaughter was traumatized by the movie and had to undergo psychological treatment and counseling.

In 2005, Richardson complained to school administrators about reading material that he said included curse words.

"This was the last straw," he said. "I feel the lawsuit was necessary because of the warning I had already given them on the literature they were giving out to children to read. I told them it was against our faith."

Messages left over the weekend with CPS officials were not immediately returned.

Kids learn enough of this crap on the streets. We don't need it in our schools also.

I agree that an 8th grade classroom group of kids probably isn't the place to show that movie, but I'm curious too - what sort of treatment and counselling was administered?

Or was it merely a CYA type of thing?

1. I agree any movie with sexual content should be approved first by the parents. At our school they send home permission slips to be signed for any PG-13 or R with the title of the movie.

2. If this case works, I think I'll sue our school for showing Al Gore's movie in science class.

Yeah, that's more appropriate for Drama.

They should have intead shown "Deliverence" under the guise of safety documentary of what not to do while canoeing in the back woods.

This is a little over dramatic. Get over it. Having said that, an 8th grade classroom is no place to be showing that movie. Any faculty and/or administration involved should be punished but I don’t think the granddaughter was damaged to the tune of half a mil.

I would hold out for more, if it were my child envolved. I'm not a sue happy person, but I also don't approve of kids being shown this kind of crap, period. I don't want my kids thinking homosexuality is normal. There are reasons it should be kept in the closet.

No, but if they start there, they can settle for less and still get what ever great new car gramps wants. Not to mention, you need to sue for that much to get the media attention.

I agree that the 8th grade is NO place for that movie. I Hope that Sub is fired, and banned from subbing in any grade below high school (to me it would be at all. Doubt she has a teaching cert., Most don't need one. But it should be reviewed if she has one.

I think the Sub is the one who needs the shrink...What was she thinking? She had to have done this deliberately. Why? Was she trying to get off on tittilating the kiddies?

I have not seen the movie, but I understand it's rather graphic, to a religious, sheltered 11/12yo girl, that could be quite damaging. Doubt her Grandparents have spoken to her much about sex. Anything she learned was from health class (hetro-only). Talk about major confusion. I could see some major psych bill piling up.

OK, enough soap box for now! :jameo:

just because a child doesn't know about homosexuality doesn't meant they are sheltered....with that said I agree with what you said...I could see how she could be damaged....I'd sue the hell out of the school and then transfer her to another school.

I would be upset that any movie with that kind of sexual content was played at school. I don't care whether it was gay or straight.

:yay:

Its not "that" movie. It's the sexual tone of it. Similarily, if any other heavily sexual content was shown.

This family are all jack-asses. .5 Million is idiotic. I hope their daughter grows up to be homosexual and her grandfather rolls over in his grave.

This country has turned into a "who can sue who for the most?"
