No one was injured, but the cup launcher, Jessica Hall, 25, of Jacksonville, N.C., was charged and convicted by a Stafford County jury of maliciously throwing a missile into an occupied vehicle, a felony in Virginia. The instructions given to the jury said that "any physical object can be considered a missile. A missile can be propelled by any force, including throwing."

Hall, a mother of three young children whose husband is serving his third tour in Iraq, has spent more than a month in jail.

The jury sentenced her to two years in prison, the minimum, and a judge will formally impose a sentence Wednesday. Under state law, the judge can only decrease the jury's sentence.

Am I the only one who is disgusted by this?

According to court documents, Hall is unemployed and, with her husband's salary, the couple takes in $30,384 a year. She receives $388 a month in food stamps.
Her husband is serving in Iraq, with 3 kids and this is ALL he gets paid? It's sad when the wife of someone fighting for our country in such a dangerous place, actually qualifies for food stamps. :ohwell:

Missile is the term the law uses for an object propelled by force, whether it be a bullet, actual missile of some sort, or thrown object the law doesn't discriminate on the object.

As for as her sentence. It sounds harsh. I would have recommended that both parties would have to complete driver improvement courses. The lady who threw the drink should have to complete anger management and stay on probation for 3 years. Perhaps by the way she thought about what might happen to her, she didn't take the gravity of the situation seriously.

However the consequences could have been worse if it was to turn out differently. What if the guy crashed and someone died? She would be convicted of Involuntary Manslaughter. She would serve time for that. Not to mention the civil suits that could be arranged. What if the contents of the cup were hot, and caused disfiguring burns to the victim? I know everyone is thinking yeah but thats not what happened.

So.... Lets say that she overshot with her throw, it goes into oncoming traffic and hits the windshield of that car. An object thrown at 65 mph plus whatever the speed of the other vehicle lets say its 65 that puts the objects applied force at 130 mph hitting a person or vehicle.

In a way im glad that they are cracking down on road rage. People tossing road maps, tacos, cups of liquid, loose change etc out the window is outta control. Some of the instances have involved firearms and other weapons and every single incident that they have usually leads to both parties arrest and or possible injury or death. People get irrate and put other drivers at risk when 2 cars are giong at it on america's roads.

SLOW DOWN! Its not worth your license, its not worth your insurance or having a criminal record. The Capital Beltway is not a level on the road rash video game!

Went to an O's / Yankees game in the 70s and a buddy of mine was arrested for throwing a missile(hot dog) at Reggie Jackson.

People make bad decisions all the time. If no one got hurt, I would think a felony and 2 years in prison is a bit much. Now, if someone got hurt, that'd be acceptable. I'd charge her with a misdemeanor, give her anger management, community service, maybe a week in jail and probation. One simple bad decision that I'm sure will NEVER happen again, and this poor woman will never be able to get a decent job.

:popcorn: § 18.2-154. Shooting at or throwing missiles, etc., at train, car, vessel, etc.; penalty.
Any person who maliciously shoots at, or maliciously throws any missile at or against, any train or cars on any railroad or other transportation company or any vessel or other watercraft, or any motor vehicle or other vehicles when occupied by one or more persons, whereby the life of any person on such train, car, vessel, or other watercraft, or in such motor vehicle or other vehicle, may be put in peril, is guilty of a Class 4 felony. In the event of the death of any such person, resulting from such malicious shooting or throwing, the person so offending is guilty of murder in the second degree. However, if the homicide is willful, deliberate and premeditated, he is guilty of murder in the first degree.
If any such act is committed unlawfully, but not maliciously, the person so offending is guilty of a Class 6 felony and, in the event of the death of any such person, resulting from such unlawful act, the person so offending is guilty of involuntary manslaughter.
If any person commits a violation of this section by maliciously or unlawfully shooting, with a firearm, at a conspicuously marked law-enforcement, fire or rescue squad vehicle, ambulance or any other emergency medical vehicle, the sentence imposed shall include a mandatory minimum term of imprisonment of one year.

This law applies to those who throw things off of the Eiffel tower and roller coasters at amusement parks in Va.

Wake up. $30,384 a year is about 1.4 times the national average income. Military also gets housing allowance, medical (not as good as it used to be), and other perks, and retirement after 25 years. I'm not saying that the pay is great, but it is not bad, and the military is VOLUNTARY! They know what the pay is before they sign on the line.

Thats wierd, I don't think the guy that threw NBA player John Amaechi a weiner got arrested? :confused:

It appears that the guy that caused the hot head to go berserk got off free and clear. By his own admission he was driving like a jerk. If she knew she was getting such a stiff sentence, she should have used an RPG.
