Since that application was pursuant to Berg's original petition, and that original petition was denied, it became effectively mute.

But, from a technical standpoint, they just released the list of orders from the January 16th conference, today. That would ordinarily have been released on Monday, but I'm guessing that the Court was closed for both the holiday on Monday and the Inauguration on Tuesday, so the orders didn't come out until today. The application was indeed denied, but its hard to imagine how it wouldn't have been.
So this ends any and everything associated with the question? Berg didn't have standing before the election, therefore no one ever need follow through?

Berg still has an appeal, of the original court's ruling, pending before the Federal Court of Appeals. They will take up the issue of whether or not the lower court's finding that he lacked standing was appropriate.

If the Court of Appeals were to overrule that decision, they would probably remand the case back to the lower court to hear the case in general. If the Court of Appeals were to uphold that decision, then Berg could, in theory, re-petition the Supreme Court to review the case. Their evaluation of whether or not to grant his petition would be based on slightly different criteria than the last time, because the case would have followed the ordinary path to get there.

Also, Berg or someone else may well file a completely new suit attempting to force Obama to demonstrate that he is qualified to be President, now that he has actually become President. In fact, I would guess that someone, somewhere already had an action prepared and ready to file as soon as Obama was inaugurated.

So, the legal activity regarding this issue is almost certainly not over yet; however, I still don't expect it will result in anything meaningful.

Do you know that for a fact? I mean a real fact, not just stuff that's running around the Internet. We know as a fact that Bush never had to show his BC at any point during his election process? A lot of assumptions are being made here.

I am pretty sure President Bush showed his birth certificate when he joined the National Guard.

Whta's happening with the Allan Keyes suit? I thought that was the best one.

He spoke at Colony South about a decade ago--flawless presentation, factual, engaging, and passionate.
It is truly a shame he could not have made it into the White House.

If Obama is all you say, I'm sure he would demonstrate that same respect for the office.

Nope. It didn't matter... it's not going to matter. Just like so many things with this president, we'll never know the whole truth. The truth doesn't matter.

So did J. Robert Kerry, when he joined the Army. Yet his BC was still required when he filed for the MD primary back in '92.

My daughter was born in Hawaii.
Her "Certificate of Live Birth" states the name of the hospital, the time, date and the name of the attending doctor.

Would one of you "tin hat" cryers please post a link to a BC that shows that information for the guy in the white house.

In one of KC's classes, they were discussing the qualifications to be president of the United States . It was pretty simple:

"The candidate must be a natural born citizen of at least 35 years of age."

However, one girl in the class immediately started in on how unfair was the requirement to be a natural born citizen. In short, her opinion was this requirement prevented many capable individuals from becoming president.

KC and the class were just taking it in and letting her rant, but everyone's jaw hit the floor when she wrapped up her argument by stating & asking:

"What makes a natural born citizen any more qualified to lead this country than one born by C-section?"

And someday she'll vote!
