I thought ALL traffic vilations were considered adult offenses despite the age..

In other words, if at 12 years old he did get a ticket, and I run a police check on him guess what? Those violations will be listed as they are not considered juvenile offenses, I won't need to get "special permission" to access his juvenile record to see those particular violations. The same as if a 16 year old gets nailed for DUI, or Reckless Driving.. automatically considered as adult offenses and aren't protected by any juveline privacy laws.

You can get a ticket at 16, but if it is an arrestable offense, it is referred to juvenile justice. A 15 year old driving without a license is an arrestable offense. Any driving infractions under the age of 16 is reffered to j/j.

Just out of curiousity when you say 'arrestable'. How much discretion are you folks allowed here? I listen to the police scanners quite a bit and quite often hear you guys giving the dispatcher a phone number to call a kids parents and have them come out and pick them up. Can't say specifically I have heard this for a kid driving w/o a license but hear it quite often for a variety of reasons.

To clarify. If you pulled over a 15 YO kid driving W/O a license. He/she was respectful and appologetic. Gave you a story of "Mom is asleep and I snuck the car out to give a friend a ride to another friend's house because his parents threw him out." Are you allowed to use your discretion here or is this an automatic thing where the kid gets a charge? Again, just curious.

Police have discretion to arrest on any misdemeanor (with the exception of domestic violence) in the state of Maryland. Same with tickets, dwi's driving while suspended, driving w/out license...etc. The officer could cite you, but may issue you a summons over an arrest.

Thanks, Again I was just curious. I guess alot of what comes into play when using your discretion is just how a person conducts themselves while the officer is discussing it with them.

I used to deliver Pizza's for Dominoes when they first opened in the park. Ran a stop sign once and also got pulled over for speeding once. Upon being pulled over and the officer realized I was working, for both instances I was given a verbal. So I am familiar with the use of discretion. But I was repectful and apologetic. I am sure there are quite a few folks out there then conduct themsleves otherwise when getting puller over for something they should not have been doing in the first place.

Where was this trooper when I was driving up 235 yesterday???? Some idiot decided he was going to run across from the Sleep Inn to the Wildewood side..... There were at least 20 cars slamming their brakes in front of me....

Luckily an accident did not occur..... but it was close.

Yeah, I know bikes are "supposed" to follow the same rules as motor vehicles, I didn't know that then, maybe he had a quota :snicker:
I don't know maybe he thought he was doing me a favor? Trying to teach me a lesson, though all I learned was an early dislike for authority.

I went to court, but the judge just laughed and dismissed it, well, I was at the court, but because I was a minor my mother was the one "officially" charged.

Earlier you said the cop gave you the citation. Doesn't happen in Maryland. A 12 year old doesn't get a citation they get charged and it is given to Juvenile Justice. The cop can't "officially" charge your mother with your traffic violation. And even if some strange occurrence happened, the total fine for these violations in 1998 would have been less than $100.00 and you said it was $170.00 fine! I suspect your not accurate in reporting this post, and were just trying to make cops look bad.
