PAX Base Cell phone use law enforcement

Is this not totally friggin ridiculous? Don't get me wrong, I wanna see cell phone use while driving eliminated, but to use THAT as the criteria? Their argument is that you can not hear emergency vehicles and such if you have those things in your ear. Bullshiat! Those things inhibit hearing less than my co-workers ear hair.


Now even listening to an i-POD type of device while on your motorcycle is illegal.

This is going WAY to friggin far.

This is the DoD policy:

(3) Driver distractions. Vehicle operators on a DoD Installation and operators of Government owned vehicles shall not use cell phones unless the vehicle is safely parked or unless they are using a hands-free device. The wearing of any other portable headphones, earphones, or other listening devices (except for hand-free cellular phones) while operating a motor vehicle is prohibited. Use of those devices impairs driving and masks or prevents recognition of emergency signals, alarms, announcements, the approach of vehicles, and human speech.

And the state law:

§ 21-1120. Wearing earphones, headsets, etc., prohibited.

(a) Earplugs.- A person may not drive a motor vehicle on any highway or on any private property that is used by the public in general in this State while the person is wearing over or in both ears earplugs.

(b) Headsets.- A person may not drive a motor vehicle on any highway or on any private property that is used by the public in general in this State while the person is wearing over or in both ears a headset.

(c) Earphones.- A person may not drive a motor vehicle on any highway or on any private property that is used by the public in general in this State while the person is wearing over or in both ears earphones attached to a radio, tape player, or other audio device.

(d) Exceptions.- The provisions of subsections (a), (b), and (c) of this section do not apply to:

(1) A person engaged in the operation of either special construction equipment or equipment for use in the maintenance of any highway;

(2) A person engaged in the operation of refuse collection equipment who is wearing a safety headset or safety earplugs;

(3) A person wearing personal hearing protectors in the form of custom earplugs or molds that are designed to reduce injurious noise levels. However, custom plugs or molds shall be designed in such a manner as to not inhibit the wearer's ability to hear a siren or horn from an emergency vehicle or a horn from another vehicle; or

(4) A person wearing a prosthetic device used to aid the hard of hearing.

So yes, it is not legal to wear a headphone, even in only one ear, while on base. However, as soon as you leave the base you can put it in one ear.

That seems to imply that wearing an ear plug that is part of a "hand-free" cell phone arrangement is perfectly legal.

THANK YOU. The person that gave me the initial information told me that the base was following state law, And I KNEW that the state allowed for ONE ear bud to be used, but not two, and I couldn't find it. THANK YOU!!!

This durtard has a poaching, weapons, assault, and burglary record, and is a deadbeat. I think I'll give the cops the benefit of the doubt on this one.

It does IMPLY that - but I just read a memo that says, it's still specifically forbidden. The only condition allowed are hands-free speaker type systems. It *specifically* states that earpieces that are part of a cell-phone system are not allowed.

Are you talking about the CNRMA instruction? I figured I'd go with the PAX instruction since that is what the question is about.

I don't know - I just saw a PDF that was forwarded to me. It makes it clear enough. It sucks, but it isn't vague.

Was that memo a notification of a change to this new regulation?

That's a law that has not yet been enforced!! As a mom of a 2 and 3 year old,....I LOVE IT!!!!
