Roadside veggie/fruit stands permit

Is there a permit required to sell veggies/fruits at the roadside stands or from the back of a personal vehicle? This time of the year I see veggie stands/trucks popping up everywhere and was wondering if they had to get a permit to sell.

What I was told was that if its on wheels, it doesnt need a permit!!!

(1) does he really find that many shark's teeth in the area; and
(2) does he really sell that many teeth to justify him being out there every single time that I pass up and down that road?

That's not what I've heard. I've heard that wheels or not, sitting on the side of the road, one would need a peddlers permit.
I find a lot of town and city ordinances that say that, but I can't find a maryland law covering it. If that's true as long as you stay out of an incorporated town you should be safe.

Field Enforcement Division - Peddlers License

A peddler or hawker who sells goods while traveling from place to place by foot or vehicle must obtain a peddler's license from the appropriate Clerk of the Circuit Court in order to sell or offer to sell any goods in Maryland.

A peddler's license is not required for:

The sale of fish or oysters in their natural and unpreserved condition, or
The sale of perishable fruits or vegetables in their natural condition, or
Licensed merchants or traders in Allegany County who have maintained regular places of business for at least five years.

There are other local laws and statutory exemptions in the State Peddler's License Law that affect peddlers and hawkers. For more information, contact the State License Bureau or the Clerk of the Circuit Court in the county where your business will be conducted.

The legal requirement for the peddler's license can be found in the Business Regulation Article of the Annotated Code of Maryland, Title 17, Subtitle 9.

What I want to know is:

Everytime I drive past him (which is pretty often), I wonder the same thing. Seems to me that he must be wasting his time just sitting there because I never see anyone there buying anything from him. Wish I had so much free time on my hands.

He spends his entire winter on the beaches hunting for sharks' teeth so he does have quite an inventory, however I am pretty sure it's not just teeth he's selling.....
