Alas, Trump Is Still Eligible to Run for Office



A law review article claiming that Donald Trump is automatically disqualified from holding elected office is getting attention in large part because it was written by two conservative, originalist law professors, William Baude and Michael Stokes Paulsen. Baude and Paulsen argue that Trump should be excluded from ballots for giving aid to an “insurrection or rebellion” in violation of Section 3 of the 14th Amendment.

There are two problems with the notion that Trump can and should be kept off the ballot by state election authorities.

First, although Baude and Paulsen’s originalism is honest and conscientious, originalists outside of academia typically won’t apply their originalism if it leads to a result at odds with their conservatism. Second, there is precedent that contradicts their argument — precedent the scholars dismiss because they say it contradicts the original meaning of Section 3.

To condense their main points, when the 14th Amendment was drafted after the Civil War, the original meaning of Section 3 was that anyone who previously held public office and then rebelled against the US government should be automatically barred from office unless two-thirds of Congress made an exception. This constitutional provision is law and requires no further action by Congress to implement it, the article says. Courts can and should apply it, but we don’t need to wait for them to do so. Any government official, state or federal, whose duty it is to apply the Constitution must obey Section 3. It follows, the authors say, that the state officials who set the ballots for the primaries and general elections should exclude Trump. If he wants to fight that in court, he can. But there’s no need for the officials to wait for a judicial determination.

To state this argument is to see why it won’t be followed by state officials. Was the Jan. 6 attack on the Capitol an “insurrection”? Did Trump participate or give aid and comfort to the “enemies” of the Constitution under Section 3? These are contentious questions of constitutional interpretation.






An article by William Baude of the University of Chicago and Michael Stokes Paulsen of the University of St Thomas slated to be published in the University of Pennsylvania Law Review suggests that Trump may be ineligible to run for president in 2024 due to his efforts to contest the 2020 election. A similar effort to disqualify then-Republican Rep. Madison Cawthorn of North Carolina for allegedly supporting the Jan. 6, 2021 riot at the Capitol building was revived by the United States Court of Appeals for the Fourth Circuit in May 2022, according to the American Bar Association Journal.

“I think this is the single most dangerous constitutional theory I have seen pop up in decades,” Turley told Fox News host Laura Ingraham. “I mean, this is an argument that under the 14th Amendment, Donald Trump can be barred from running again, ever holding office in the federal government because he violated his oath. He supported an insurrection or rebellion.”

“Under the 14th Amendment, you have this bar on federal office, if you supported or if you gave aid and comfort to an insurrection or rebellion,” Turley continued. “Now, of course, that brings you to the original question. What was January 6th? In the view of many citizens, including myself, it was a protest that became a riot. It was not a rebellion or insurrection. But that’s a matter of disagreement between citizens. But Donald Trump hasn’t been charged with insurrection, not even incitement. Special Counsel Jack Smith charged him with a variety of crimes like fraud. He notably did not charge him with even incitement.”

A scared and cornered Donald Trump pulled out of the Republican debates this week knowing he can't defend against his numerous legal challenges.

He also cancelled an event Monday where he had planned to show evidence that the election wa sstolen from him.

How many times are you guys gonna keep falling for this?

Rememeber when he was gonna release his Taxes, Then he was going to introduce a new health care plan? and all the times he was going to prove he won the election?

Your boy Creepy Joe is the only one who has failed to support and defend our Constitution, and thereafter rebelled against that sacred charter, either through overt insurrection, but especially by giving aid or comfort to the Constitution’s enemies.

I really don't care what Asa Hutchinson has to say. He's a waste of air. Ditto Nicki Haley, and whoever the rest of them are. Mike Pence...seriously? Chris Christie....who gives a ****? In fact I can predict what each and every one of them will say:

"Joe Biden sucks and I'm the only one who can beat him. Donald Trump is the worst and we must destroy his supporters. I'll fight for the American people. Vote for me."

The only interesting candidate (besides Trump) is Ramaswamy, and I'll bet you right now he'll be ignored and shut down. And he's not going to win the nomination anyway, so I don't really care what he has to say either.

I'd watch a debate between DeSantis and Trump, but only if it wasn't being moderated by some Deep State tard trying to manipulate the audience. I'm completely over Bret Baier and he's one of the reasons I haven't turned on Fox in months. I don't even visit their website anymore - I get my news from NewsMax now.

I don't blame Trump one bit for not wanting to debate Baier, who also happens to be the guy in control of the microphone.

Another prediction:

Trump's interview with Tucker Carlson will beat the ever lovin' sh*t out of the debate in terms of viewership. It will be a slaughter. Immolation.


Translation. I only listen to deep state media and ignore everything that doesn't confirm my Nazi world view.

I have completely abandoned every source in my life other than Trump and his Newsmax mouthpiece and will only become more angry, isolated, and radical.

Georgia school removes pornographic books after Libs of TikTok exposé



A Win For Cobb County Students and Families!

On August 19th, we reached out to the Cobb County School District via email to ask them for comment on why they were offering pornographic themed books to their students.

One of the books offered is “Flamer” which contains graphic depictions of sex and discusses watching porn and masturbation.

Two days later we received a response from Chief Strategy and Accountability Officer John Floresta. His response is what all parents should want to hear! It read, “Any book, video, or lesson which contains sexually-explicit content is entirely unacceptable and have no place in our schools, period. Over the weekend, we have removed both books from all of our schools.”



Email response from the district

The district also reportedly sent out an email to parents and staff on Monday, August 21st notifying them they removed the two books in question.

We followed up and verified on the district’s website that the books previously marked available now shows as “in processing” or were already pulled and are unavailable for students. This is what the library catalog was showing before:

John also wrote that they were “unaware” that these books had any explicit material in them until he received our email and thanked us for notifying them. He also stated, “at the direction of our Board and Superintendent, we are unapologetically holding our staff accountable to only use content which is aligned to Georgia standards, our Board’s policies, and the Law.”

Damn, I lived and worked in Cobb and later Paulding County 89 to 93.... wtf happened???????
