Adjoining property owners received notice today And signage was placed last Tuesday but was removed on Friday With the announcement.
Ok. When I say "notice" it's not a matter of days but weeks if the things I mentioned need to be addressed.

Now, was the "meeting" a Public Hearing or an informational one? Those don't have many requirements and don't even have to be held.

Those two forested areas in the center of the picture is the lands in question.
Both owned now by KATHERINE ANN BONINCONTRI and PHILLIP R BONINCONTRI.

The plot on the left purchased ARMS LENGTH on 06/21/2024 for $275,000 is 39.5800 ACRES and is zoned AGRICULTURAL. Tax account number: 05-027462.
The plot on the right purchased NON-ARMS LENGTH on 10/28/2024 for $100,000 is 10.8 ACRES and is zoned RESIDENTIAL. Tax account Number 05-011965

The plot on the left looks smaller than 38 acres because it carries downward below the seconds property line.

Katherine is the President and Executive Director of PASCAL CRISIS SERVICES INC. Phillip is the Chief Operations Officer of PASCAL CRISIS SERVICES INC.

They bought those two properties in their personal names and not in the name of their company's incorporation, ie not in the business's name. I'm guessing of which was done to fly under the radar.

the builder hosted a public informational meeting a day or two before the en of April at the library. Very short community notice.,,the library was packed and the commissioners were absent. the planning and zoning meeting was to beMay 22 for this issue bit has since been withdrawn. this Is the sign that wa put on mount wolf r last week.

Funny. Here's a thought. They personally bought both plots for a total of $375,000 and want to have it re-zoned to commercial, or something higher than agricultural and residential that would accommodate a care facility building. Then they say, oh we decided not to build the center. Now they have land worth what? Maybe 5 times what they paid for it, or more. Then decide to sell the land to a developer for a tidy profit.

Since the land was not bought and paid for by the Pascal corporation, it throws serious shade on the veracity of their claims.

It looks like they wanted a conditional use, which is likely allowed in the Zoning Code. No Commissioners would have to have attended the informational meeting and actually, since this would be a Board of Appeals hearing, would have no authority to approve or deny the appeal.
If the typical process is followed the request has been moving through the system for awhile now. The first stop would have been the Planning and Zoning Commission which would have made a recommendation to the Board of Appeals to approve or deny the conditional use. What was that recommendation?
The Board of Appeals does not have to follow what Planning and Zoning recommends and they can alter any condition or requirement put on the project by P and Z. In theory the applicant has to prove why the project is necessary, doesn't conflict with allowable uses and would be beneficial. In practice many Boards of Appeals rubber stamp any project brought before them.
If the appeal is denied the next stop for the applicant is Circuit Court, opponents can do that too, but most give up at that point.

You are right that this has been going on for a while . The community should have been informed by their elected officials. I am not sure of the recommendation from planning. This is a copy of the perk application which was clearly submitted by the property owners as commercial use.

Why should the elected officials have told anyone? In all likelihood they didn't even know, they don't get reports on every P and Z application filed, building permit received or site plan submitted. About 99% of the time they find out the same way everyone else does, they read about it in the newspapers.

I was at a meeting the other night and happened to mention a project that was in the works in Town (and has been literally for years). Afterwards one of the Council members asked me about it because he had no knowledge of it. That's in a one square mile Town with 2000 residents.
