Raskin says Trump’s Georgia case ‘custom-made’ for racketeering prosecution
In an interview on CNN’s “State of the Union,” Raskin pushed back against the concern that bringing a RICO prosecution could eventually risk jury nullification if the jury ultimately finds that the charges are an overreach.
“[RICO] applies to a pattern of racketeering activity that is organizing people together into a conspiracy in order to achieve an illegal end — in this case, the overthrow of a presidential election and substituting a counterfeit process made up of fake electors for the actual process that the people voted on. So there are lots of component criminal parts to it, and there were a lot of people involved,” Raskin said in the interview.
“And that to me, seems as if it’s custom-made for a RICO prosecution, the way that we’ve developed it,” Raskin continued. “If people want to talk about reforming the RICO statute, then we can analyze that, but it’s been upheld against constitutional attack repeatedly.”
Raskin — who was the lead impeachment manager in January 2021 against Trump and sat on the Jan. 6 select committee investigating the attack on the Capitol — made the case that RICO is not, today, used in most cases in order to prosecute the mafia.
“Well, RICO has been used mostly not against the mafia, if you look at all of the RICO prosecutions in the country at the federal and state level,” Raskin said. “Of course, there would be something strange about a law that applies only to one group.”

According to Raskins description of RICO, his girlfriend Hillary Clinton Schiff, and Nadler, and he himself are all eligible for a RICO investigation.

During an appearance on CNN, Rep. Jamie Raskin (D-MD), one of the more prominent House Democrats who spearheaded the Select Committee to use the riot as a political cudgel against former President Donald Trump and his supporters, chimed in on the news.
Host Wolf Blitzer asked Raskin why he believes Johnson agreed to release the footage. The lawmaker responded by claiming that he is “clearly on the run from the extreme MAGA caucus, [Rep.] Chip Roy, and the strongest pro-Trump elements.”
Raskin continued, intimating that Johnson is close to being deposed as was former Speaker Kevin McCarthy (R-CA).
Raskin argued that Carlson “did his best to torture out tens of thousands of hours of footage…which…went nowhere.”

First, the Constitution says you can't run if you aren't a citizen of the U.S. That's not questionable. But what does that have to do with the fact that you're trying to take away the rights of your political opponent and the rights of the millions who would vote for him (and defeat your weak, unpopular candidate)? What a laugh how they claim that they want to "protect democracy," yet they push for this.
Second, Sec. 5 of the 14th Amendment says Congress shall have the power to enforce the provisions, not every state making up their own minds and having all kinds of political decisions. I wrote about that in talking about the dissent of Colorado Supreme Court Justice Carlos Samour, in addition to all the other reasons the 14th Amendment doesn't apply, including that there was no insurrection and he wasn't charged under the applicable federal statute, 18 U.S.C § 2383.
