I would like to amend that to single out defense attorneys and most attorneys who deal with lawsuits. Prosecutors are okay.

I think that they are holding back the other two in case they need to have a second trial. If the first trial ends with a hung jury or something stupid. They can always try her in the deaths of the second two, avoiding double jeapordy.

I think that is why the state only prosecuted three of the deaths so if or when it comes time for consideration of her release they can then prosecute her for the remaining two as there is no statute of limitation for murder.

And I really see no fault for the lawyers in this as they are just playing their role in our adversarial judicial system. Someone has to do it and they are bound to be just as zealous in defending a person as those doing the prosecuting.

I think it is the system that could be improved if those found "not guilty by reason of insanity" for heinous crimes such as this were confined forever as they, in my mind, will always be a threat to society as their actions have shown them to be. Maybe the state legislatures will realize this and enact laws to correct what truly seems to be a loophole.

Most law makers are themselves lawyers. Loopholes that make money for lawyers will never be closed. Insanity defenses are a cash cow for lawyers.
And yes, I do expect lawyers to prosecute or defend to the best of their ability at all times.

I see fault in it. Ensuring that the accused has a fair trial is one thing - trying to get someone who is guilty as sin off on a technicality or insanity plea is just wrong.

I might debate whether people like Andrea Yates even deserve a trial - she admitted she did it and was caught red-handed. What more needs to happen? After that, all her lawyer was trying to do was get her off completely or get her a nice cushy hospital stay, when JUSTICE would be the death penalty.

What sentence does one normally get when you murder five children? If you're not their mother, that is. :rolleyes:

In Texas, death. In other states who knows. The insanity plea for me is a loophole that needs to be removed. As has been stated, you have to be a little "touched" to kill someone unless it happens while defending yourself or others and is ruled justified.

If you want to blame anyone for her defense look at Katie Couric, as best as I can tell she was the one that started the Yates Defense Fund to hire these hot shot lawyers?
