Yeah, I went back and read the rest of the thread..

Horticulture is a major.. then he can grow his own..

I saw a job on the federal job site for a horticulturist....starting pay was $52k....all I thought was "damn, someone gets paid that much for picking weeds and planting flowers", I'm getting the wrong degree :lol:

Wow, I took 3 years of Horticulture in high school, never thought it would go anywhere so I didn't pursue it. Live and learn. :killingme Seriously though, it wasn't for me and it took me 3 years to figure that out. I can't grow a plastic plant now.

I plant....the moles tunnel around....some die....I replant in the spring

I weed on occasion when I'm on the phone with my mom :lol:

Wow..I took two years of horticulture in college. Dropped out when a friend pointed out " you can lead a whore to culture but....."

Wow, guess the curiosity bug bit during the night. I havent packed up the computer yet...
Think there is a bit of confusion, no one has been tested for anything.
Im still on the leave of absense. Think Im gonna just go give them my ID and whatnot, and be done with it. I love the "whore-deculture" bit! thats hillarious!
One other thing, you probably would be suprised at how many people actually do smoke around here and how many hold normal respectable jobs.
Maybe Ill check back later before I pack this thing up. If not I wish you all well.

I think if all the companies around here actually did random drug tests (like they claim they do) we would loose half our work force. That doesn't bother me...pot heads are annoying.

It is shocking how many people do drugs knowing any minute they can get tested.

then they ##### about how it's not fair, or right and how drinking is just as bad. Missing in the argument is they KNEW that there was a drug test, or that they could be randomly drug tested.

I wish they would do more tests honestly, but like you said it would kill the workforce.

Guess thats a matter of personal opinion. Thats what most of this thread seems to have boiled down to. Too many people concerned with what others do in the privacy of thier own home. Personally I dont advocate anyone using it anywhere else. Or driving for that matter, just as I wouldnt recomend drinking and driving or drinking at work. As for those who are concerned with the legality of it, are you as concerned with someone who speeds?

Not really.

I don't drink enough for it to adversely affect me. A beer in the evening, but I don't get drunk by any means. :shrug:

I also don't condone doing so, especially if it means coming in to work hung over. We fire people who do that. :shrug:

By your logic I should be able to rape my neighbor as long as I can get her into my house.

Weed is illegal. Period.

Deal with it. If you are going to b*tch about it, get more active in getting it legalized. :shrug: All the power to you at that point.

In so far as Title I of the ADA (the part which deals with employment issues) is concerned, someone currently using illegal drugs is not regarded as a 'qualified individual with a disability', to the extent that the employment decision in question is based on the illegal drug use. Generally speaking, an employer can test for illegal drug use and fire an employee on the basis there of. From 42 U.S.C. § 12114:

For purposes of this subchapter, a qualified individual with a disability shall not include any employee or applicant who is currently engaging in the illegal use of drugs, when the covered entity acts on the basis of such use.

To the question of whether an employer has to provide an alternate position to an employee with a disability that can no longer perform their original position's functions, that's a trickier question and depends on facts and conditions specific to their situation. Generally speaking, an employer has to be willing to make 'reasonable accommodations' for the employee to be able to continue working. What does that mean? Well, for starters:

The term “reasonable accommodation” may include—

(A) making existing facilities used by employees readily accessible to and usable by individuals with disabilities; and

(B) job restructuring, part-time or modified work schedules, reassignment to a vacant position, acquisition or modification of equipment or devices, appropriate adjustment or modifications of examinations, training materials or policies, the provision of qualified readers or interpreters, and other similar accommodations for individuals with disabilities.

The problem with such terms, and with legislative provisions like many of the ones included in the ADA, is that, no matter how many hundreds of pages of regulations the bureaucrats write to facilitate the application of the legislation, interested parties sometimes can't know for sure what they mean until some judge decides. Thanks, that is some interesting information.

Also, once again, my leaving the company has nothing to do with illegal drug use. It has everything to do with me haveing a siezure disorder and my doctor explaining that I cannot "stand at hieghts" use ladders and be on top of aircraft. I feel that this is the wake up call I should have taken into count about haveing seizures and doing this type of work. Oh well, I find the prospect of going back to school rather exciting. Maybe Ill fianally learn to spell! :smile:

I don't know about you, but everybody in my area gets called for random testing at least once a year. Key word, random. Some were tested twice before others donated.

But it's been a short notice, show up and produce on demand. Now they are going to ask for a bigger sample (I guess that means we should stay properly hydrated_
