Does that mean we have to sell? Can he live there and if he wants to sell we split it?

You can do whatever you want to do with the house, UNLESS you ask the court to decide.

If you two have it worked out, don't give it to the judge to figure out for you.. he'll most likely make you sell NOW and you'll lose a lot of money.

It's yours and his property, not the judges, and not the lawyers..

You people who got off on the cheap are lucky.

I know of two cases in court right now that have run over $30,000 dollars apiece. The kids are the problem. Fighting for custody is an expensive process and women dont always make the best custodial parents.

Wow, I did get out of the situation cheap and easy. I agree, women (mothers) aren't always the best. But I am a little biased because I have custody of my child....:yahoo:

getting custody is always the cheapest, but its hell getting there, i have been going through my divorce for over 2 years and im still not done. this is what happens when 2 parents do not get along and there are property issues. i would like to invite all of you to my forums page and help my site get moving. these are the exact things id like to discuss there. its a dads website, but there is also a forum for the women.

Well, for me, I had to be separated for a year (without contact) and then things went pretty quickly. It all depends on what assets you have to work out. I didn't want the headache, so .....things went fairly quickly for us. Hope this helps.

You don't have to sell if you can keep the place up by yourself. You get an appraisal for the house and the ex gets 50% of the equity. Maryland law = 50/50. Then you refinance to get the 50% equity to pay the ex and get the deed and the mortgage in your name only. Have them put on file at the courthouse so there is no question. I had to do this just to keep a roof over my kids. Financially difficult for a long time, but worth it in the end. Get any loans before the divorce is final because divorce makes your credit go to crap.

Sure, it she signs off on it. My ex took it. :shrug: Maryland is a 50/50 state. She's entitled to 50% of everything.

:yeahthat: And if you have kids, you can make an agreement to let the custodial parent have the house for X number of years and then sell. Often, they split won't be 50-50 because person moving out isn't contributing to the "house" anymore.

Much of what happens depends on the attorneys, what the couple can agree on, etc.

Maryland isn't 50/50, it's an "equitable" split state. They look at contributions..income, etc. if the parties can't come to an agreement.

Had two lawyers in Maryland tell me that she was entitled to 50% of all marital property. 50% of the equity in the home, 50% of the savings, 50% of retirements, etc.
