They were functioning as police officers. Otherwise, why would there be an internal police investigation. It is really hard to answer your questions as most of them anybody with even a moderate level of intelligence would know the answer.

The aide had no responsibility to ensure public safety. She had a responsibility to provide appropriate care, which she obviously did not. That's why people who provide these services have licensing and training requirements - so that they know better than to leave someone who needs their assistance alone without the support they need.

I've had the police "help" me in an emergency. They were useless.

I hope you never need them in an emergency either, considering the average response time is 10 minutes.

This is where I think the security/police made a bad judgement.

Well there's your problem. You are taking the word of an ambulance chasing attorney over the word of the people who were present.

I know exactly how things work, the dude is dead, no matter what you call it. He's dead after, and only after the police:

Sure does, there had been a rash of SD people sneaking in to the movie theater. It was a serious problem. An the SD guy was just smashing one of the security officers head on the ground. I bet all THREE security guards were fearing for their lives.

according to the story in the OP that is exactly correct, the police were not in uniform at the time.
