At the very least, a GOP leaning Secretary of State somewhere can refuse to certify the candidate or, later on, the electors. Niether has happened.

That's what Alan Keys' suit is about. He wants the California SOS to certify eligibility prior to allow the electors to vote.

Obama has released his COLB to the LA Times. Politifact.com has several other documents that prove Barack Obama is, in fact, Barack Obama. And the Hawaii Department of Health has confirmed his BC exists but state law prohibits them from releasing it to the media.

What's next? Obama didn't personally reply to an email from the kooks at WorldNetDaily so he isn't a real person? :roflmao:

So, the New Jersey Supreme court would have to make a ruling on the facts?
If that court rules he is, in fact, ineligible, do the other states automatically invalidate their elections based on this ruling?
I thought the Berg case came from a federal court in PA. As far as NJ, I think that would only impact NJ but it would definately get national attention if any state supreme court ruled Obama ineligible.

The LA Times is an incorporated business that is not a finder of legal fact nor are they a court.

Politifact.com is a cheesy intardweb site and they are nor a legal finder of fact or are they a court.

The Hawaii Dept. of Health is a governmental filing cabinet that looks in an old dusty file and says "Yup, there is a paper here with Obama's name on it . They do not find fact either.


Saying that the LA Times has seen his COLB and it is good enough for them is like going to the counter help at the local Dunkin Donuts and asking them to decide on your upcoming court case.

...but what I was saying is that any one of the 50 SOSs could've refused to certify Obama as a candidate in the first place before the campaign got started. It would've taken only one GOP SOS to cause a stink and the BC issue could've been dealt with way before we got to this point.

If you lost your COLB (but I guess that doesnt happen to anyone since it's a big ####in deal), you can order an official copy. Costs $20 in the People's Fascist Republic of Maryland I believe.

My understandig of the Keys case is that unless some outside party claims a reason to investigate, the SOS isn't compelled (or authorized) to act.
It seems like nobody is authorized to check out tha basic items of someon's past. Until now, this has been the press's job, which they have failed.
 
OK, if the SCOTUS agrees to hear the case and entertain oral arguments, could the court compel 0bama to produce a certified copy of his BC? I mean, has the SCOTUS ever required any "evidence" to be submitted? I was under the impression the court only heard arguments and that the extent of the testimony would be interpretation of laws, treaties, conflicts between the states, etc. but no actual physical evidence would be presented.

Inquiring minds want to know...

SCOTUS has pretty broad discetion and could do any number of things IF they decided to grant Berg's petition. One of those things would be to overturn the lower court's dismissal and remand it to them to hear the case. They might also decide, after considering the merits of the case, not to do anything and allow the lower court's dismissal to stand. They could also rule on the actual case themselves, or give legal guidance on specific aspects of it.

The application by Donofrio (which is the one that originated in NJ) is a request to grant a stay prohibiting the NJ SOS from taking certain actions (I believe certifying the electors). In that case, the Court will either grant the stay or not grant it. Technically, there isn't a case to refer back to the lower court, because Donofrio hasn't even bothered to ask the Court to review a lower decision yet. It's pretty unusual - he should have filed a petition asking them to review the case which formed the basis on which he is asking for a stay.
