The left threatened impeachment countless times for his "crimes". None if it stuck, but it never stopped the relentless pursuit by the left to accuse Bush of every ill this country suffered for the past 8 years.

A few minor updates, in case any one is interested:
(1) Someone named Bill Anderson has filed a motion for leave to file an amicus curiae brief in regards to Berg's petition. Basically, someone unassociated with the case is asking the Court's permission to file a brief addressing some points that were not mentioned in Berg's original petition. He has to ask permission from the Court before filing if he cannot get consent from BOTH the petitioner (Berg) and the respondent (FEC, Obama, et al) to do so.
I found a lawyer named Bill Anderson in Washington, D.C., but don't know if it is the same person. It is hard to know what issues he wishes to bring up, and whether of not they would be favorable to Berg's petition.
(2) Justice Souter has denied another application for injunction that Berg made pursuant to his petition. I'm interested to see if he refiles the application with another Justice. If he chooses not to, I believe that is pretty strong evidence that he does not believe his case can succeed on its merits, as I had speculated a while back. That doesn't necessarily mean he thinks he is wrong, just that the case can't win. Regardless, unless something out of the ordinary happens, his petition won't even be considered before January 9th.
(3) There is another case before the Court that hasn't been talked about much. An application by Cort Wrotnowski (08-A469). Procedurally it has followed pretty much the same path as Donofrio's, and it is now scheduled for the conference this Friday (the 12th). In fact, it was apparently prepared by Donofrio. I briefly looked over it and it seems to be constructed more appropriately, but makes much the same weak arguments. I don't look for it to be granted.
