Hello all,

My partner and I were camping this weekend at Point Lookout as we had an additional day, because our daughter was off of school on Friday. We left Thursday night and set up camp. Friday morning we showered and headed to the store (Shoppers off of rt 5). Once we got inside our daughter was acting up (As 6 yr olds will do) and continued, I warned her that if she continued, she would get a spanking, she continued and I smacked her on the bottom and walked her out of the store and picked her up and carried her to the car. She continued in the car as we sat and waited for my partner to finish shopping. I spanked her in car and she continued her outburst. She then began to settle down and we talked about it and went back into the store to catch up with my partner. We finished shopping and went to the car which Destiny and I sat waiting for my partner to go to the dollar store for a couple more items. When we were leaving the parking lot we heard sirens and moved over, only to discover they were for us. I followed their direction and pulled over off of the street.

We had an officer approach the car very anger and Hot!! I got out of the car with my wallet in hand and he started screaming. I was on the ground with a cut on my forehead and a kick in the side of my chest by Officer George of the Sheriff Dept. A woman, who called the police was at the site where we were and my partner said she opened the back door and took our daughter out of the car and over to her vehicle. without any police. A total stranger. I must have an attorney this week, who can handle this and has no problem with Gay dads. I tell you, we are lost, scared and don't know who to turn too. Our Daughter is the most important person in our world. We have and continue to focus our lives around who we are as a family and we have a great family. My daughter as well, had no marks, no red spots, nothing. All this is based on the history of one woman, who when my partner went up to get Destiny, said what are you doing, she said who are you and he said, "I am her Daddy" and the woman replied I thought he was (Pointing to me on the ground from the sheriff) her Dad. My partner told her "she has two Dads, now butt out".

I was charged with 2nd degree Child Abuse which is a felony and up to 15 years in prison. We are fairly new here in Maryland (From Michigan) and I am very scared of what could happen.

I don't like to give out such detail, but I also know when I need help. If anyone can assist, please let me know. And if you know anything about St. Mary County legal system, please tell us. I must be in court in just 10 days, so I appreciate any and all input.

I do believe in God and I have been in prayer a lot over the weekend. We were with other people camping and we were so grateful to have them with us. Family is what we are about and now we, including my Daughter are scared of the police.
This doesn't sound accurate. There is no such charge as second degree child abuse.

That is the way they entered the data in the judiciary system and they show Officer George as the complainant. Could he have made this arrest off duty?

§ 3-601. Child abuse

Child abuse in the first degree

(b)(1) A parent or other person who has permanent or temporary care or custody or responsibility for the supervision of a minor may not cause abuse to the minor that:
(i) results in the death of the minor; or
(ii) causes severe physical injury to the minor.
(2) Except as provided in subsection (c) of this section, a person who violates paragraph (1) of this subsection is guilty of the felony of child abuse in the first degree and on conviction is subject to:
(i) imprisonment not exceeding 25 years; or
(ii) if the violation results in the death of the victim, imprisonment not exceeding 30 years.


Repeat offenders

(c) A person who violates this section after being convicted of a previous violation of this section is guilty of a felony and on conviction is subject to:
(1) imprisonment not exceeding 25 years; or
(2) if the violation results in the death of the victim, imprisonment not exceeding 30 years.

Child abuse in the second degree (top)

(d)(1)(i) A parent or other person who has permanent or temporary care or custody or responsibility for the supervision of a minor may not cause abuse to the minor.
(ii) A household member or family member may not cause abuse to a minor.

I believe child abuse used to be one single charge, without a measure of degree, and I think this was changed within the last few years (maybe longer – time does fly) and it was done to differentiate the sentencing guidelines if I remember correctly.
