Wow from reading all these posts I am feeling like I'm getting overcharged. We have T&S and pay $84 every two months.

New Vision Garbage Service and the "Garbage Wars"

Well, I finally canceled my contract with New Vision Garbage Company and filed a complaint with the Better Business Bureau. The owner apologized and offered me one month of free service. I declined his offer because they hadn't lived up to their promise yet, so I had no reason to believe that things had significantly changed.

I did sign up with "Affordable Too Garbage Disposal Company" out of Waldorf. They are at (301) 645-5967. I'm not sure what areas they serve, but it may be worth a call to find out. They normally charge $96.00 per quarter, but are aware of the "garbage wars" in our area. So, they charge me only $66.00/per quarter. They may be willing to negotiate if you mention the other options.

The customer service was outstanding. The only catch is you have to buy your own trash can. They said that they had some on order, but did not know when they would be distributed. I like honesty even if they don't say exactly what I'd like to hear. I signed up on Monday, purchased a trash can from Lowes, and they picked my trash up on Tuesday. They pick up on Tuesdsays and Friday. So far, they haven't missed yet. My neighbor also signed up with them.

I hope this helps and appreciate the good feedback I'm getting from this forum. I think it's great when consumers share ideas...keeps us from getting burned.

It's great that you got your can today. On the day I canceled my service, they delivered the trash cans on my street the same day. I think the owner may have gotten a wake-up call after the bout of cancellations and complaints. I simply trasferred my trash can over to my other neighbor who decided to give them a try. I'll monitor his situation to see if there is any improvement. You may have noted that the New Vision cans are a bit smaller, I believe 60 gallon can vice the 96 gallon can, that Waste Management provides.

I am interested in your experience with New Vision as time passes. Thanks for the post.

Finally heard back from New Vision...

All,

I finally heard back from New Vision yesterday (via e-mail sent on 10 Aug). Thanks to my paralegal skills and my contact law and ADR classes, I was able to resolve the issue through some negotiation. They came back with an offer I though was fair and reasonable. I accepted to continue service despite having to place our unsightly trash bags on the curb until more totes become available. We'll see how the rest of the service holds up...

If you are interested in doing the same, below is what I did to resolve the issue. This is considered friendly neighborly advice (not to be misconstrued as legal advice or pro-bono paralegal work). Just one neighbor helping nother....

In my demand letter, I first stated the issue(s) or the complaint.

Then provided the facts (i.e. dated signed contract, what was discussed, by who it was discussed, and where New Vision failed with their contact; basically, who, what, where, and how...), and how I tried to resolve the issue with no success (i.e. phone calls, conversations, with who.). Save your personal feelings and rants for another forum. As much as I wanted to lash out irrationally, I knew it wouldn't help my cause.

Moreover, I included a demand statement. A demand sample is provided below if you want to use it...feel free to modify as needed. However, any large cash settlements, I get 1/3, and at least 7 billable hours...for all my butt pain this issue has caused lol I wish I could charge for billable hours in the air force... all the overtime I put in, I'd be rich :) Your taxpayer dollars hard a work...my earning most likely totally the same salary as flipping burgers...3 more years left until retirement, yay! Anyway, back to the subject.

Please Note: If New Vision provides an offer of free service for inconvenience, and if you signed up by 31 July, you are already entitled to a month's free service, in addition to their offer. If you should accept their offer, be sure to include that in your acceptance letter, so you are not trying to resolve that later... I had to send a corrected acceptance immediately following my previous one.

Disclaimer: In no way does the demand statement sample or the contents of the blog represent legal advice in any way shape or form or cause the person submitting the blog to act unethically as outlined in the National Bar Association's Code of Ethics for Paralegals

SAMPLE:

"It is demanded that New Vision Trash provide compensation to NAME and ADDRESS for the # days (to wit: DATES) New Vision failed to carry out their part of the contract (to wit: collect the trash at the above-mentioned address on the schedule days and deliver a 96-gallon trash can); in addition to any other missed trash pick up dates that may occur until this issue is resolved or the service is terminated.

It is further demanded that a 96-gallon trash can, property of New Vision, to be used by the customer for the duration of the contract and trash service is provided by New Vision Trash & Disposal, as outlined in the contract.

If these issues are not addressed in five (5) business days, more stringent action will be taken."
**********************************************************
Sorry about the disclaimers, I've got to cover my backside. Good luck with fighting the good fight....now back to my ADR final exam essay :)

Sincerely,

Janel

Suggestion - 50 gallon trash can

I saw my father in laws trash can today he got from them , it was more like 50 gallons, it looked TINY. Also i still have the new vision flyer and it says "free 96 gallon trash can" on it. Hope you all dont get screwed with these guys.

Your father-in-law should request some form of compensation...like an add'l 50gallon trash can until a 96 gallon can be provided or half off the quarterly amount...he is only getting approx. half the service for more money; FOUL! The bottom of the can should list the capacity...or maybe under the lid...

Best of luck...see my other post...there may be some helpful info for him...

Not impressed so far; we had to make an appt to sign a contract; for trash pick up!? Usually every where I've been it was done through a phone call; The appt was about 3 weeks ago.

My husband and I changed our trash service from Waste Management to New Vision because WM said we could put anything in our trash can and they'd take it...well, after the WM picked up some dry wall in our trash can, the driver apparently didn't like the fact when the trash can came down from the crane and hit the pavement, the dust from the can blew up and on him (ok, I feel bad, but it was a little funny; of course he was dress like he was going clubbing, not picking up trash; getting dirty is the nature of the job.).

As for New Vision, we were told the trash can would be delivered within the first week; we are still waiting three weeks later. In the meantime, we've been bringing our trash to the dump.

After numerous voice mails left with the regional rep, and no return call...I went online to find an alt. number. I was told there was a mix up with the delivery and we should have one today..they told us to put the trash bags on the curb...and they'll pick it up today...we'll see...Not impressed so far.

If there was a known mix-up, they should have called their customers informing them of the problem and when to expect the arrival of their trash can...and what to do in the meantime....I finally got a hold of the Rep today, but was not very helpful by redirecting me to the office number...telling me there were over 1K new customers and they ran out of trash cans...they rec'd more cans this week and hope to have one out to me shortly... I'll let you known how they are when they actually pick up the trash.

Issue negotiated and resolution is in the works...still waiting on trash can, but are finally picking trash bags left by the curb. See my last post if you are having problems...it may be helpful!

Our WM Can too

My next door neighbor dropped WM and signed up for NV, that was almost 3 weeks ago and they still havent delivered his new trash can to him yet. AND WM still hasnt picked their can up yet :killingme Its still in his driveway..

I used Allied Waste, its $68 per 3 months but they do tack on like $7 for fuel fees, so its still cheaper than WM and they have ALWAYS shown up to pick our trash up. They only pick up trash one day a week though, but sometimes we dont even fill it up every week. We are going to stay with Allied Waste, the NV company just seemed too good to be true.

edit: just found my allied waste bill.. i was slightly off when saying how much it costs... its 65.55 every 3 months, then $9 for fuel fees, last bill was $77. Im not positive if they cover all of charles county, but you could call to find out...

Here is their contact info...

Allied Waste
300 Ritchie RD Capitol Heights MD 20743
301 336 1000

Our WM can is still in our driveway too... they told us to put it out on Monday 2 weeks ago and they didn't pick it up We put it out several times after that, and it stil is in our driveway...maybe we'll use it for NV, lol

I saw them on BBB, they were racking up the dings...I wish my husband allowed me to check them out first before signing...but he was so annoyed with WM, he signed with the first opp.

A little checking with BBB can go a long ways. I saw your posts regarding the demand letter. Thanks for sharing. And, yes, I can appreciate you covering your backside with the caveats intervowen throughout your post.

I thought about going that route, but the slick talker sales rep, Sebastian, and the compmany had lost my trust and I did not want to deal with them anymore. My letter to them was similar to your demand letter, except I just demanded that they give my money back. I also chided them a litte bit at the end of my letter for making broken promises but did not go overboard.

I signed up with New Vision a couple of weeks ago, we had WM but their bill kept going up and up, the last one was for $130.00. New Vision said $66.00 a quarter and that they will bill us, they did bring the container when they said they would and so far they have picked up when they said they would. WM still has not gotten their container which was supposed to be picked up the first week of August.
So far, so good!!

Thank goodness!!! It must be Christmas in August!!! We finally rec'd our 96-gallon tote!!! Let's see, trash has been picked up, CHECK, 96-gallon tote rec'd, CHECK, New Vision provided a prompt reply and compensation offer, CHECK!!! Me thinks they may finally have it together now!!! Good luck if you should chose New Vision...this process only took since the end of July!

Update: I live in the Greenbrier subdivision and it seems New Vision is not doing a bad job and offing a good service now that they have finally got the problem of their backorder of Garbage cans. So again we have homeowners who have switch with no issues.

On another note, I contacted Waste Management customer service (800) 553-7771 and when I told them how much New Vision Disposal is charging and If they wanted to keep my business they would have to match it, they stated they would and lowered my rate to $67.00 a quarter ($131 was old amount) and waived the tax and fuel surcharge for 1 year! So looks like a win, win situation, but you have to call WM to get the discount! :howdy:

I just take my trash/recyclables to the Convenience Center off Rt 6 in Charlotte Hall, it's FREE and on my way to work.

Time and gas is money spent also; plus I don't like the smell, look or creatures it may attract holding trash on my property!!! :coffee:

I think that is a funny name for a trash service for some odd reason.

Hubby does the transfer station and takes big items to the dump. Weekly trash dump doesn't cost us anything plus he always stops and gets me a glazed donut. This is working perfectly for moi. I have even been known to go to the transfer station. Once or twice. Not icky or anything.
