No Jail Time For Former BDVFD Captain Perv!

It's not just VFD or people like that who get off scot free on serious charges.

So who actually goes to jail anymore? Supposedly the cells are full but we continually see habituals getting suspended sentences, PBJ, charges dropped, etc etc. How many crimes can I commit before I actually have to do some time? I may go into a new line of work.

Understand California is set to release over 10,000 criminals due to overcrowding and costs.. No set parole or time off for good behaviour, just sending them home.

From a legal perspective, I guess it makes sense. From a parental perspective, I wouldn't want him anywhere near my 16 year old girl

F that. My oldest daughter is almost 27 and I wouldn't want him around her either much less the my little one. A perv is a perv in my book.

How is taking this to trial protecting every other six year old girl? What if the victim refused to testify? What if the defense attorney cast reasonable doubt upon the girls story? Who is being protected then? Like I said, these sentences drive me nuts too, but I understand the need for them.

Take it to trial and lose and the guy gets to hang around kids again. Take this plea deal and he can't be around kids at all, and....his pretty picture is on a web-site for the rest of his natual life!

I think in most cases like this, you take a plea to protect the victim from having to face a trial. Does that help you understand?

I believe we all understand that part of the process. But this little girl has shown a great deal of courage by engaging in the trapping (it wasn't entrapment)of the guy by calling him several times to get an admission of what he had done so many years ago. I wager she would have been very effective during testimony and that a judge could have protected her from an overzealous defense attorney.

Maybe, I don't have any inside information about this particular case. I do know that it is one thing to help with a case, and another to face the person who did this to you, and.....to tell everyone in the court what happened. Reporters, spectators, etc. It's a whole other situation to tell a cop (or in most cases a social worker) about what happened, than to have to repeat that in a court with all those other people.

The judge probably took into account his military record....he's retired USN.

Too bad they can't recall him to active duty and court-marshal him.

Why would the judge consider those things? Who gives a #### whether he is retired military

He abused a young girl

And I find it odd that he was able to get government employment with pending charges

Seems to me that every time I hear of someone doing jail time its for DUI or driving on a suspended license. BUT if you kill someone will DUI, you're only in the clink for a year or two. :shrug:

A large part of the detainee population is probably drug offenses, not dealers, just possession and the mentally ill. Reason #1; they have nothing to offer the state, they can't testify to their own ####. Reason #2; nobody gives a crap about them. Reason #3; they are mostly dumber than a bag of rocks - hence they get caught. Sometimes it's petty crimes, like theft under $1,000 or even less. Since the sentence can be 5 years, most will take 12 months or less and look at it as a bargain. It's a revolving door system. They go in, they come out, they go back to using, they go in...

I know for sure that is what the victim wanted. The victim is intelligent and strong enough to make up their own mind and decided this is what should happen.

The victim is still a child. What a horrible burden to place on a wounded soul to have to make such a decision.

It is terrible, no question. And she should not have had to endure testifying.

HOWEVER, victims don't always have to testify. He should have gone to jail. This should be about what HE did, not about what the child is (justifiably) still afraid of. She has a good heart and should be commended for it, however, there are MANY MANY adults surrounding this case who know better.

He committed a heinous crime. And should be punished. Not kept free to take on the next kid.

This child should have been protected from having to make such a decision. Shame on all of the adults in her world - ESPECIALLY this judge.

Complete bull####. YOu can plea out AND add sentencing. Sounds like ALL of the adults wussed out in this case. Complete crock placing the burden of responsibility entirely on the child's shoulders. You grownups need to grow the #### up. Do your ####ing jobs. Put these people away. The judge did NOT have to accept this.

I've had good luck with Abrams and am quite shock that she let him walk. I don't give a flying #### what the victim wanted. The man committed a crime and needs to do his time. It was Abrams' job to see to it that he was locked away. Tier 3? For fondling little girls? Ridiculous.

Tier III is actually the level with the strongest/heaviest registration requirements. he must report every 3 months for the rest of his miserable life. NOT that it takes away the ridiculousness of not getting a jail sentence...but a lifetime choke-hold... he WILL be choking!! read this attachment...
