I understand what you are both saying. They are not going to think, well, I'm already committing a felony, better not take the gun cause if I get caught there is a 5 year mandatory federal sentence with that on top of my burglary time.
I just hope that they consider this as pre-meditated murder, maybe that is doubtful, but it carries much more weight as far as sentencing. The statement in general pisses me off because they are trying to minimize what they did. We just went there to steal; we didn't mean to kill anyone. Yeah, ok Guns don't kill, people do.
What still puzzles me is leaving the knife in the bed last visit,
stupidity...they had it up there for who knows what reason and forgot about it...just like the other evidence they forgot about....the cops had evidence place at least two of them in the house. These boys got in waaaay over their heads on this one.

Its part of that mentality NOW a days. What did you expect them to come in with for the burglery - boxing gloves??? a sling shot??? What still puzzles me is leaving the knife in the bed last visit, other than it could have been there from them entering the bedroom last time "just in case" someone was in there... now they think.. oh crap... I left a knife in the bed, better bring a gun in case they found that and can use it against me??? :shrug:

Now, on a lighter note, I think as punishment that is just and reasonable for us Redskin fans, is to have them play first string for Dallas for 20 years, as quarterback, running back, receiver and coach

It is very sad that he was killed defending his family and killed in his own bedroom at that. Soo much talent and he was turning it all around, its just sad. As Brian Mitchel said - "people ask why he was down there, when there was burgleries going on in his house recently, he died protecting his family, he died being a Man and thats more than any football recognition can give you. People burglaries places all the time with no weapon at all. If they are startled, they run. Gun tooting criminals are more common depending upon demographics. If I was the attorney representing the state in this matter, I would certainly argue the fact that going to a burglary with a gun would be pre-meditated murder, may not win, but most certainly would argue such a thing.
Again, if I was defense attorney, I'd argue that he was with their peers and on a big mission of robbing a very prominent and wealthy athelete's house, why not take all precautions necessary :shrug: let alone, they were young and obviously not very experienced at this (as in 20 years of experience in robbing homes) :shrug: They were part of the thug mentality and lets bring our guns. :shrug: This was a thrill for them of sorts. I don't know that you understand this mentality. shrug: I wouldn't say that bringing a gun was pre-meditated murder at all, especially, when you are intending on robbing someone, its more of a threat than anything and maybe as the professionals involved saw it as - it was a robbery gone bad. They were young and maybe felt it was self defense when they realized someone was home :shrug:

I have not been following the developments closely, so I don't know if they were apprehended or came forward voluntarily. If they came forward on their own, it would go a long way as to intent; a robbery gone bad and a very big mistake. They did shoot him in the leg; often a non fatal wound. If they were apprehended, then they have more of a problem with convincing me that they were not prepared to kill during the robbery.
...but if I am apprehended next March (or Feb, when the smoke ban goes into affect?) coming out of a bar with a pack of smokes on my person, can I really be entitled to any claim of innocence of intent to smoke?
It just seems to me if I break into a home, armed, whatever happens after that, I should not be entitled to say "I didn't mean to shoot anyone. I thought the home was empty."
Why the cigarettes? Why the gun, then?; I was at minimum thinking about it and for sure prepared and planning for it. Isn't that intent?
I guess it is intent, but coming forward on your own lends to credibility of what you say in my opinion. "I didn't mean to kill him. I shot him in the leg." holds more weight than if they were caught and drug in and then said the same thing.

The only protection the law abiding have in terms of protecting lawful possession and lawful use of firearms is the vigorous opposition to unlawful possession and use.
It's all going to depend on the complexion of the Dade county jury selected in this case. You can be sure the family of at least one of these idjits is trying to get Johnny Cochran resurrected!
