If they lose it, the blame falls 100% on the defense attorneys. Richards sat on his hands for days letting potential objection after objection pass him by. They even submitted evidence which showed a photograph with their own labels saying something like, "Is this Kyle pointing a gun at xyz?" playing right into the prosecutions argument that Kyle provoked the attack.
The other thing to consider, if the defense does not object to something, they can't file an appeal on the matter at a later date because there was no decision for the appellate court to overturn.
Now, it looks like they have 2-3 holdout jurors. People inside the courtroom have told attorneys that one female juror cried most of the last day of testimony anytime a witness was on the stand. 2 or 3 are full time mask wearers. This could have all been prevented had Richards taken advantage of the juror research and jury selection experts that attorney Robert Barnes made available to the defense. Instead, Richards completely ignored them, according to Barnes.
Being cynical, maybe the defense wants a mistrial so he gets another pass at that juicy multi million dollar defense fund?
At this point, I think we either get a hung jury, or maybe a partial guilty, partial not guilty finding -- if the majority gives in to the holdouts just so they can go home.
