It's pretty simple actually if all you say is true. You build a case that shows that you are immeasurably a better provider for your kid and you file for a change of custody hearing then you don't accept no for an answer.
thats what we are working on know. I actually just dropped him off to her and she said she is aware of the offender living with them and sees no problem with it because she says she watches him all the time and she can take care of herself and my son and said she will not be leaving there and neither will my son.
when did you two divorce? why? how come you didn't seek custody then? how often do you see the child? do you pay child support?
divorce was final in august 07 and we were seperated 2 years prior.she left me for a friend of mine because times got hard she has since drained him and now lives in the current situatio. we did custody at the same time and came to an agreement and i have joint physical custody and she has sole leagal custody of him. I see my son every wed and every other weekend.
Proof of what? Proof he isn't living there?
He is supposed to be living at the address that is on the registry. You mentioned he was released in August 07? Wouldn’t he have a parole/probation officer? Have you spoken to that person, or just the registry?
proof he is living there with them. you would think he has a probation officer but i dont know how to get that info.
Does your ex work? If so have you spoken with the Daycare provider? Also have you taken your child to a therapist? In a situation like this is may help your as well as help your child.
she says she does but yet she is always calling me and her other ex for money. she took him out of daycare because she wanted the money from child support for herself and didnt want to spend it on day care. I am in the process of getting a home evaluation which includes a drug test and physciatric eval. The court ordered a therapist before she went once i went to all the meetings and the court never enforced her going.
A digital camera is a wonderful thing, so is a private investigator, believe me it works
that is what my next option is i am looking into that now.
Time for you to fire your current lawyer and spend some $$
