Another Biker Killed by a Dumbazz

......
It doesn't state that the biker had the right of way in the article. You're assuming that.
She was making a left turn in front of an oncoming vehicle. The oncoming vehicle (motorcycle) has the right of way. Been there and had it done to me. The other guy got a ticket for it on the spot. It's called failure to yield the right of way. I was lucky I was in my car at the time.

Manslaughter

Maryland law:

(b) Prohibited.- A person may not cause the death of another as a result of the person's driving, operating, or controlling a vehicle or vessel in a grossly negligent manner.

Did you see something in the article that leads you to believe that she was "grossly negligent?"

That takes more then inattention, like intoxication or recklessness.

Is there a traffic light there?

Well this little tidbit here seems to be a clue... "A 52-year-old man driving a motorcycle was killed"

But hey, I could be wrong.

Doesn't matter if there's a traffic light or not. If you're making a left hand turn in front of oncoming traffic, you have to yield to the oncoming traffic. Mine happened on Great Mills road. Some idiot turned left in front of me and I hit him broadside. His fault. Police gave him a ticket on the spot.

Accidents happen every day, and people die from them every day. That doesn't mean it is "gross negligence" every time.

Of course it matters. If there was a light, and she had a green, then she had the right of way. That's why I'm saying the article is too vaque.

What charge would you jail her for?

Vehicular manslaughter. It is a crime to cause a death by driving a vehicle in a grossly negligent matter. She caused his death and is completely at fault. The "I didn't see him" defense is meaningless. It would be the same if I started shooting a rifle in a park and "accidently" shot them because I had my eyes closed.

Because we're all perfect drivers and no one here has EVER made a mistake. Good Lord.... The woman already has to live with the fact that her mistake cost a man his life. I'm not saying she shouldn't be fined or have to pay some sort of restitution to the family but manslaughter?

True, but I would assume that if a light was not mentioned, there probably isn't one.

I wouldn't assume anything considering the woman hasn't been charged, but that's just me.

I don't like that anytime a bike gets hit everyone automatically assumes the other driver was at fault. I've seen some pretty stupid people driving motorcycles.

I didn't say you said it. I'm just trying to make sense of the original post. Even if she did hit the motorcycle, it doesn't say who had the right of way.

Yes it does.
Anne Arundel police said the accident occurred when Talbott tried to make a left turn from Priest Bridge Center ( a side street) onto westbound Defense Highway (Maryland Route 450) (main road). Police said the motorcycle was headed east on Defense Highway.

"The crash occurred when the Toyota SUV drove directly into the path of the motorcycle,"

If the bike had run a red light, it would have said "the bike drove directly into the side of the Toyota SUV

Ah, yes, but SHE gets to live. This isn't a fender bender, or a little boo boo. She Killed a man. "some sort of restitution to the family " How do you make Daddy come back, or son, husband, brother. There is no restitution possible, only punishment.

If a person can go to jail for not making child support payments, not paying taxes, marijuana, copying DVD's etc..., how about for KILLING a person?

Accidents do happen. But REAL accidents are incredibly rare. Most "accidents" are directly attributed to a lack of attention or negligence.

Oh, for cryin' out loud. If daddy was that concerned about not being there for his family he should have kept his ass off the motorcycle. Anyone who rides a bike has to know the odds are against them every time they get on one.
