Frisking or a "patdown" is a search of a person's outer clothing wherein a police officer or other law enforcement agent runs his or her hands along the outer garments to detect any concealed weapons or other contraband.

In the case of Terry v. Ohio, 392 U.S. 1 (1968), the Supreme Court of the United States held that police have the ability to do a limited search for weapons of areas within the suspect’s control based on a reasonable and articulable suspicion that the person stopped was "armed and dangerous" and had been, is, or was about to engage in a criminal act. The type of frisk authorized by this decision has become known as a Terry stop and frisk or simply Terry stop.

A Terry stop has two parts: the stop and the frisk. When Terry stopping someone, the officer must have a reasonable suspicion that criminal activity has, is, or is about to be committed. During the course of the law enforcment agent's stop, if the officer feels that the suspect is in possession of a weapon that is of danger to him or others, he may conduct a patdown of the suspect's outer clothing garments to search for weapons. For the frisk to be constitutional, the officer must testify that he conducted a patdown for his personal safety, or the safety of others in the area. Pursuant to the "plain feel" doctrine, police may seize not only weapons discovered in a Terry stop but also contraband when the contraband nature of such is immediately apparent to the officer. An officer may not, however, seize such contraband if its identity is not immediately apparent to the officer upon administering the frisking.

I guess I should be for the ATF having access to everyones private gun collection just in case in the future a gun crime is committed against me too??

The only problem this is, they don't. Having a gun within your private property is different than when you take your car on public roads. Once you enter into the public domain, our taxes are paid to have protection measures put in place to keep violators off the roads. Just like the airline analogy... even though you are getting on an airplane that is owned by a private company, the airspace it flies over is not their airspace and is subject to being protected by our government.

I don't get what the big deal is here? If you don't want to go through the check point don't. If you pull off and a police officer follows you to ensure you are driving within the law, ie; not crossing any lines, correct speed, paying attention to signs, then what is the harm in that? What would you recommend we do? Just not pay attention to anything, and during times when there is a high expectation of people drinking and driving do nothing to prevent it? Those that are complaining are probably the first to say we do nothing anyway.

Wrong, I have many friends who are cops, I have 4 exended family members who are cops and I work with atleast 6 former cops. I think overall most cops are good. I just see so many that are Jacked Booted Thugs now days that have no desire to uphold the Constitution.

Hell look how many police chiefs you see blantly speaking out against the right of individuals to own guns. That is BS. Courts have already found that police are not responsible for an individuals protection, yet you don't want the citizens to have a right to defend themselves?

Listen I comply with sobriety checkpoints of course, do they deter drunk drivers, yeah, are they a great way to round up a bunch of drunk drivers? No.
I just don't feel that I should be mandated to stop and engange in a conversation with a cop on my way home when there is no probable cause for me to be stopped. I think that alot of times they are fishing expeditions in desguise, which to me is a violation of the 4th Amendment.

I don't know what else to say, I am obvisouly not alone on this..... although most on this board would probably disagree. I can take you to a few gun boards where even about 1/2 the cops agree with my posistion.

It is just mind boggling to me for some you to think that my posistion is so outrageous, there are a lot of level headed clear thinking people that are right along with me.

Sooo, if I follow through with my plan to find a checkpoint, make a LEGAL U-bop, and drive within the law, I can't be pulled over because my rear window doesn't allow the following officer to see I'm properly belted into MY PRIVATELY OWNED (MD=taxes, taxes, fees, taxes) vehicle w/dual rear mirrors and tinted (lawful %) windows?

I know you don't make the laws, you only enforce them, but if you can't see that I'm properly belted, is that PC to pull me over?

I have done some ride alongs........... believe me, if they want to pull you over, although you have really made no infraction, you will be pulled over.

So your saying you....the defender of the 2nd, 4th and 6th amendment, saw a police officer violate someone's rights and you didn't report him/her?

What does that make you?

YA THINK???? :roflmao: Will do. I don't wanna go for a full shift, but 3 hours on a Friday or Sat, say 8 - 11 should be fun. Can I request that Erin go with us? That would make it WAY fun.

I just want to thank you for doing what you do. It takes quite a person to put up with the BS you do, the weird hours and so on and for not the greatest of pay in the world.:coffee:

The scanner will be crazy with the beep beep beep for the next three to four hours I am sure. To sleepy myself to try and stay up though.

You made a comment in a thread I read about jury duty. I couldn't do a ride along because my luck, I would know one of the darn people that get locked up.:killingme I say that because even though I am getting ready to start my second term of jury duty in the last five years, the first time I had it the only trial I was due to sit on was for the father of a co-worker's son. How embarrasing to have to hold up your hand in court and say " Yeah I know so and so":killingme

Oh yeah I called her on my cell from the parking lot of the courthouse that day and said" You will never believe!!" she said "yeah I figured you would be there!!"
