DOJ Drops Campaign Finance Charge Against Sam Bankman-Fried

The campaign finance violation charge was among eight counts present in the DOJ’s original indictment—which also includes wire fraud, securities fraud and money laundering—in December.

In the filing addressed to New York federal judge Lewis Kaplan, the Bahamas did not include the eighth charge from the original indictment, a campaign finance violation, in its extradition treaty.

“The Government has been informed that The Bahamas notified the United States earlier today that The Bahamas did not intend to extradite the defendant on the campaign contributions count,” the DOJ letter said. “Accordingly, in keeping with its treaty obligations to The Bahamas, the Government does not intend to proceed to trial on the campaign contributions count.”

The notice came hours after a hearing over Bankman-Fried’s alleged attempt to discredit former Alameda Research executive Caroline Ellison by sharing private documents with the New York Times.

🔥 The Wall Street Journal did run a very surprising story yesterday, headlined “Judge Sends FTX’s Sam Bankman-Fried to Jail Ahead of Fraud Trial.” The sub-headline added, “Onetime crypto entrepreneur handed personal effects to his lawyers before U.S. Marshals handcuffed him.”

Buh-bye:

According to the Journal, before revoking Sam’s pretrial release agreement and sending him off to jail, the federal judge explained that Sam had repeatedly “pushed the limits” of his bail conditions, and that “there is probable cause to believe that the defendant has attempted to tamper with witnesses at least twice.”

Specifically, Sam had been feeding New York Times reporters private emails and texts from his polyamorous girlfriend Caroline Ellison, and the judge believed he did it to pressure her and get her to testify a certain way: “even if in modest part, to influence those people, to have them back off, to have them hedge their cooperation with the government.”

Mess around and find out. Sam’s lawyers pledged to appeal, citing Sam’s freedom of speech rights and the difficulty of planning his defense while Sam sits in jail. My guess is Sam and his lawyers took an (unethical) calculated risk trying to influence his trial, and the judge spotted it. Whether or not they accomplished their objective is impossible to say at this point.

Sam Bankman-Fried Upset After Jail Refuses To Accommodate Vegan Diet, ADHD Meds: Report

Attorneys for Bankman-Fried voiced the complaints during a Manhattan federal court hearing on Tuesday, claiming the Metropolitan Detention Center hasn’t given him medication for his ADHD and the jailed man has only survived on water and bread alone — sometimes with peanut butter.

“Your Honor, that’s outrageous and needs to be remedied,” Attorney Mark Cohen told a Manhattan federal judge, according to The Associated Press.

Cohen said his client was “being denied medication to focus” for his upcoming trial on October 3.

Magistrate Judge Sarah Netburn reportedly said she would look into accommodating Bankman-Fried’s dietary restrictions and medical needs at the detention center.

“I’m reasonably confident they provide vegetarian options,” Netburn said. “A vegan diet may not be available, but I assume a vegetarian is.”

Attorney Christian Everdell reportedly told the judge, in addition to Bankman-Fried’s living conditions, that his client was also being denied the right “to effectively prepare for his defense” with getting only two days per week to review millions of pages of evidence.

🔥 Speaking of problems, after violating his gentle pre-trial release conditions and then being ordered back to jail, plump tech bro Sam Bankman-Fried can’t seem to catch a break. Now his problem is cruel and unusual punishment. The AP ran the story Tuesday, headlined “Jailed Sam Bankman-Fried can’t prepare for trial without vegan diet and adequate meds, lawyers say.”

Judge Kaplan had revoked Sam’s pre-trial release and ordered the prosperous tech bro jailed after concluding there was probable cause to believe Sam was busily tampering with witnesses.

According to his lawyers’ complaints to the judge on Monday, the failed crypto-giant and FTX founder is hungry and distracted. Apparently the young tech ‘entrepreneur’ can’t adequately prepare for trial in six weeks, because he is languishing in jail without proper access to computers, video games, non-prescription Adderall to help him focus, and a better diet than bread, water and peanut butter.

Okay, I added video games. But we all know it’s true.

The reason Sam is only eating bread, water, and peanut butter is because the delicate genius eschews meat. He’s a vegan or something. Flesh makes him vomit. Allegedly.

You’d think a real vegan would be a little slimmer and better focused. Weird.

Bankman-Fried, 31, is accused of stealing billions of dollars in FTX customer deposits, spending tens of millions on his businesses, speculative venture investments, sketchy charitable donations, and making illegal campaign contributions aimed at influencing cryptocurrency regulation in Washington and electing democrats.

As I’ve noted before, Sam never created anything before launching his failed multi-billion-dollar crypto company. The whole thing stinks. It has a very Jeffrey Epstein-esque stench to it. Not the human trafficking part, the propped-up-by-intelligence-agencies part.

Anyway, the judge denied Sam access to computers, but said she would order necessary medications and allow a diet closer to his vegan preferences.

So don’t feel too sorry for Sam. He’s doing fine. He’ll choke down whatever veggies they give him, don’t worry. He’s tough. Sort of. Well, not really.

“If you can’t do the time, don’t do the …” something. I can’t remember.
