I wonder if there is some kind of exemption for an "agricultural" project? My planting requirements are shown in detail on my site plans...have you seen the actual site plan?

So what? Looking at the site plan and the size of the property it looks like they meet all the restrictions easily.
It's not just located near a body of water. It is located less than 50 feet at head waters, the watershed, to the creek which leads to the river. All water runoff clearly enters at the wetland forks, or drainage basin, at the corners of the property. I doubt any other industrial operation in this area, which this clearly is, would pass muster if it weren't for the politics of the industry being promoted and by Mattingly, an old and established county name.

I have seen the site plan and the soil conservation plan, it's all public information, as is all the health department paperwork. This operation, in my opinion, should be classified as Agricultural/Industrial. Frederick County has a grow operation and they are the ONLY county that labeled that operation as Ag/Ind. LUGM, and related agencies has designated it as Ag/Crop which makes it eligible for a "farm plan" which negates the need for planting Sherwood Forest.

For this project, all the boxes were checked for it to proceed. However, the county, in their ignorance of commercial grow operations gave the wrong set of boxes to check to this outfit. They were operating under the assumption that the plants were going to go in as a row crop, like corn or soybeans.

The industry is also being promoted state wide with SB 1 calling for allowing legal recreational use. Also, if you say you have an "agricultural" project/plan for your property, the wheels tend to turn with less resistance.

Now that does not surprise me..
The proposed plan also calls for an additional 47,000 - 52,000 sqft of buildings and space for 115 parking spaces. But you and I have to spend hundreds of hours and dollars before we even get a piece of paper from LUGM denying us permission to put a 10x12 amish built shed on our property.
