Locker rentals

All Up In Your Grill
 I can remember sharing a locker in highschool because there were not enough lockers for everyone. My locker partners were always slobs and there was never enough room in the locker for both of our stuff. They needed shelves in them.

My daughter wallpapered her locker. She picked up a clip on reading lamp yesterday in a shade to match. :yay: The furniture is being delivered next week. It's gonna be really nice.

Either the school or whomever governs the school.

You'd think, but the issue was over a kid in high school who's locker was searched and they found all kind of illiict drugs - what he was selling.

Lawyer that was defending him said it was an illegal search as they didn't have a warrant, they didn't ask the kid (or his parents) permission to search the locker.

Argument was who had the authority (who 'owned' the locker) to ok the search. School didn't 'own' the locker, or it's contents so their consent to search was worthless.

Search student locker - can a school official do this?

Can a school official search a student's locker?

While the U.S. Constitution upholds the right to be safe from unreasonable searches and seizures, the standard for school searches is less rigid. The search is lawful if the school has a "reasonable suspicion" that a school rule has been violated. This means the search must be justified when made and reasonably related to the circumstances being investigated. For example, a student is believed to have been smoking on campus, but denies it. A reasonable search can be made of the purse or backpack he or she was carrying at the time of the incident. His or her locker and pockets can also be legally searched. Courts will weigh a student's right to privacy against a school's need to obtain evidence of school rule violations and violations of the law. This "reasonable suspicion" standard has been upheld in challenges to locker, desk, and car searches.

They really do nickel and dime us. Son needed $3 locker rental (and has to share a locker), $15 for spanish workbook, $15 for Foundations of Technology lab fee, a flashdrive for the Found of Tech class and another flashdrive for Health class (why do you need a flashdrive for health class?). Plus the $80+ I spent over the weekend on the various binders and other school supplies he needed. Also, class pictures are next week and the cheapest package is $42 for a small amount of pictures. Picture cost will be twice that since I have 2 kids there.

I think this keys on "reasonable suspicion". In other words the principal can't just decide to inspect all the lockers in the school, nor can he call in drug dogs to find drugs in the lockers at school. AND if he does, and the dog alerts on a locker, and he, or the cops search the locker without consent, it's an illegal search.

The same as your house. If there is reasonable suspicion (ie following OJ's bloody trail to his front door) you don't need a warrant to search. If there is no direct connection/suspicion, or have not witnessed a crime, you must get a warrant.

 Yep, that sounds like 9th grade, except my son needed an additional flash drive for Science.

The dog alerting on the rundown shack on the corner is not reasonable cause for a warrantless search

In My Opinion
I hear you. Girl told me I need $5 for renting a locker WTF. Did the schools get short changed with the amount of money they got so they have to charge for lockers. I wounder if they will charge for the gym lockers as well.
St Marys schools did not get short changed.
average per student spending in St Marys is just over 9,000 per year, compared to 6,050 in Anne Arundel and $7,051 per student in Baltimore city.

I bet that the PTA or PTO depending on what you have there, is getting the money.
So much money gets sucked out of AA county to support Baltimore City and PG (because the way the district lines are drawn, that a couple years ago the PTO had to beg parents for money to replace old lockers.

I wonder if it's more a legal issue.

I remember there being issues with wall locker searches, and convictions resulting from.. The question at the time was who owned the locker, and who had the warrant/ authority to cut the lock to get into the locker.

If the school rents the lockers to the student the question of ownership has been resolved.

Actually, that is not true. When the schools rents the locker, they no longer have legal access to it without permission. Just like a landloard can not search the home he rents out, the rental aspect changes the privacy rights.

I talked with the Assistant Prin. at Margaret Brent today regarding this. She told me they use the money for school activities. Sometimes for classroom supplies; sometimes for assemblies and such. I may pursue this more and ask for last year's financial statement under the Freedom of Information Act. I am just curious. If they asked for donations, I would give them more money than just the $4 rental fee. I just don't like the idea of them charging for locker usage. Next thing you know they will want to charge for "chair rental" or for the use of the bathoom facilties.

Are you serious?

Yep! I asked girl why she needed money to rent skates. She said that "some of the skates were ruined last year, so the school needs money to replace them." Not sure how accurate that is, but that's what she was told by her gym teacher.

I told her that she didn't ruin any skates last year so I'm not paying. Then I wrote a note to her teacher asking for "documentation" of the rental fee.

We'll see how that goes.
