So now they have decided that I didn't really cancel my membership and are trying to dog me for another month, plus another declined card fee, plus another late fee. AND! they threatened me with a collection agency.

I would contact the Maryland Attorney General and see about their consumer laws. A little research on their website might provide some info.

Long story, and I can elaborate when I see you later, but AT & T were trying to sock my mother with all kinds of fees because they sold her a freaking new cellphone contract when she thought she was getting a "pay as you go" cellphone when her OLD contract was up. I was tyring to straighten out the damn charges and late fees & yada yada while she was in ICU in Florida. As I said --LONG story. I called the customer service department and laid it on thick and I told them I was going to take the case to the Florida Attorney General and I would have their asses for fraud against an elderly person and a few other choice words in very specific language.

I got all the charges dropped. I got her contract voided, I sent them back the phone and we never heard back from them. But I did have to use strong language and I had to talk to several people until I found the right one.

Same exact reason I no longer subscribe to XM or Sirus Radio for the cars.
Like Im going to remember every auto pay and call them when a new card is issued.
At least Nationwide called and did not charge any fees when I failed to call them about the auto deduct from my bank card.

They were like, your card was declined for payment.
I said it was because a new number was issued and I forgot to call.
they said, no problem, I gave them the new number, she ran it, it worked, and it was done. All over the phone.

I can't believe you just insinuated Vrai's an elderly person, I think Bann's going to be more of a description than a user name now.

That's how it's supposed to work. I have never EVER heard of a company charging a declined cc fee. But, like I said, I was all whatever and went down there to pay what I owed and cancel my membership, now these aholes want me to pay more money and keep racking up charges.

So if this thread helps one person to avoid them and their shoddy predatory business practices, I'll consider it a success.

Bann, thanks for the idea about the AG. I'll give them a call on Monday. :yay:

I think the declined credit card fee is a new invention by the Obama crowd. Don't you remember when the President, by executive order, I believe, allowed people to cancel any contract they had with finance companies and demand forgiveness of any penalties and fees? Part of the quid for the finance companies was new penalties.

In theory, how is a declined CC fee any different than a declined check fee? (Honest question, I am not wise in the ways of these things)

Now I'm all paranoid, I'm on a contract with Maximum and I think I have a year or so left.

I'm not sure. I know banks have bounced check fees but that is for the person who actually wrote the NSF check. When someone bounces a check to me, even to my business, I don't get charged. My business also does not incur a fee when one of our clients' credit card is declined. I think it's just an arbitrary penalty and aggravation fee.

All I can say is if you cancel your membership after your year is up or at any other time, get EVERYTHING in writing and save ALL your receipts. Videotape the counter person telling you you're paid in full and your membership is canceled. Do not trust them.

I got a pretty good one for $100 :yay: I also bought an elliptical, Bodyweight station and a total gym. With all my boxing equipment I ended up with a pretty fair gym. (This picture was before the elliptical & total gym).

I see you have the all important FAN <G>.

I used to lift at Max for over 2 years. During those 2 years they steadily declined in my eyes.

I went in to change in the men's locker room once and it smelled like pee and it was obvious someone vandalized it...I asked a girl working the front counter and I was told "oh, don't worry...it's a water leak from the old CiCi's" I was told later that management had "upset" someone and guys were coming in the locker room and peeing on the floors. Couldn't they be truthful with their members about this incident so I could wear some flip flops in there while changing?

The only thing I'm bummed about is Victor was always a pretty cool guy...he's the only good thing that place has going for it.

Nice! That's a really good looking basement you've got there!

I've been slowly building a nice little workout area in our basement. It's got weights, other various equipment like tires, resistance bands, bosu ball, and the Lifeline suspension stuff but I lack cardio since I had the gym contract. There doesn't appear to ever be any shortage of people selling their treadmills on Craigslist, though!

I thought the industry had reformed their membership practices years ago.
I remember investigative pieces on shows like 20/20 about the difficulty of getting out of what turned out to be a costly contract.
