Unlike many of the lawsuits regarding Mr. Obama's citizenship - which claim he was born on foreign soil - Mr. Donofrio's case concedes that Mr. Obama was born in Hawaii as he claims. Mr. Donofrio contends, however, that Mr. Obama is not a "natural born citizen," as Article II, Section I of the U.S. Constitution requires.
"Since Barack Obama´s father was a citizen of Kenya, and therefore subject to the jurisdiction of the United Kingdom at the time of Senator Obama´s birth, then Senator Obama was a British citizen 'at birth,' just like the framers of the Constitution, and therefore, even if he were to produce an original birth certificate proving he were born on U.S. soil, he still wouldn´t be eligible to be president."

I heard this on the news this morning. The problem is that wether or not Obama had British citizenship, it doesn't matter because he was born in the US. As far as the US is concerned, he was born here so he's a natural born citizen. There's nothing in the Constitution that says he can't have had an extra citizenship. Besides, if the whole British citizenship thing is true, it still doesn't matter because that citizenship expired when Obama was 18 or 21.

Clarence Thomas pushes Obama citizenship case onto Supreme Court docket - The Daily Voice - Black America's Daily News Source

The source (i.e. Washington Afro-American newspaper) cited in that article is either misinformed or intentionally being misleading:

Instead of rejecting the application, Thomas distributed it to his colleagues, and the issue was scheduled for conference on Friday, December 5.

... The latest move by Justice Thomas was first reported by the Washington Afro-American newspaper, which described it as a "highly unusual move."

..."Thomas's actions were rare because, by custom, when a justice rejects a petition from his own circuit, the matter is dead," the Afro reported.

I cited this several weeks ago in this thread, it's from 'A Reporter's Guide to Applications', prepared by the Public Information Office SCOTUS (page 4):

If a Justice acts alone to deny an application, a petitioner may reapply to any other Justice of his or her choice, and theoretically can continue until a majority of the Court has denied the application. In practice, applications usually are referred to the full Court by the second Justice to avoid such a prolonged procedure.

That's not to say that the application couldn't be granted, but the fact that it was scheduled for conference doesn't mean anything. That's consistent with standard procedure.

I would say that I would be surprised if this particular application was granted.

Berg's petition hasn't even been scheduled for conference yet, so who knows when that petition will be considered. The only other conference before next year, is next Friday, the 12th. I question whether or not there is enough time to distribute it for that conference.

Probably for the same reason that if someone accused me of killing Jimmy Hoffa and hiding his body, despite all evidence to the contrary, and insisted upon my providing evidence that I indeed did not kill him and hide his body, I'd basically say f-off.

I'm pretty sure Pres. Bush didn't spend too much time responding to Berg's allegations that his Administration was responsible for the 9/11 attacks, and that's probably the best way to respond to whacked-out conspiracy theorists.

Perhaps someone could clarify - I was under the impression that his birth certificate has *never* been produced - only that Hawaii has issued a document claiming they've seen it. This video seems to indicate that both birth certificate and the COLB were never in dispute - only the definition of "natural born".

Just think of all the money wasted from these law suits when all it takes is simply supplying the info. There is Constitutional requirements for the office, whereas your above analogy has nothing to do with the Constitution. I would just like to hear one lib to say 'hey, turn the info over and be done with it'. I have yet to see one lib find it odd that the messiah could end all this but refuses to do so.

NOBODY else has seen an actual copy and the one posted on FactCheck.org is obviously an altered .jpg file. The serial number has been blacked out to prevent it from identifying the person it was actually issued to.

I had to show a little ID to get my job and it doesn't have nearly as much responsibility.
I don't understand why it would be a big deal to produce it in court.
