We just had the court serve someone a notice. I cant remember what my husband paid but it was not bad. They will personally deliver the notice to them via the sheriff or court appointed person. They then tell you when its been delivered. Its worth the money. Also if your witness is not in person all statements typed need to be notorized to be allowed as evidence in the civil case. Good luck!

My witnesses have all agreed to be supeonaed (?). They will be there in person. St. Mary's charges 40.00 to serve the court papers.

You can also have a third party serve her. A willing friend at no cost..Good luck and I am glad your girl is doing better.

I don't know what is wrong with people letting their dogs run loose and refusing to pony up for damages caused by their dog. My neighbor's dog bit me a few weeks ago, the wound got infected, spent a week in the hospital and the owners refused to pay the medical bills (no insurance here). That is all I was asking for at the time. I see an attorney tomorrow and now I am going for the bills and whatever else I can get. Animal Control has been called at least 10 times by me for their dog (pit mix) running loose. They just ignore AC and let the dog run. All AC does is come out and tell them to control their dog. This is also in Callaway. We also have a really bad pit bull in our neighborhood but this one tends to stay at the other end of the road.

I can tell you from experience that if the dog was on your property, you will win the law suit. The judge will say that if the dog didn't come onto your property then the incident wouldn't have happened in the first place. Good Luck.

:yeahthat: I've done it for a friend before. You knock on the door, someone answers, you make sure you're talking to the right person, hand 'em the papers. Done!

and since she won't answer the damn door, I'll have my friend beat the mother fu*ker down, bust up in there like she owns the joint, wait for the cops and have the damn cops hand her the court papers and save myself 40 bucks. :banghead:

When you appear in court the judge is not going to want to deal with anyone but you and her and anyone who witnessed the actual event. The post office is cheap start there, it'll be worth your while.

If this lady won't pay and the "land owner" has given permission to the dog owner for access to the property, I'd be sending the land owner a bill and talking to my insurance co. about damages.

Also, I have to say there's alot of people here suggesting :whistle: taking care of the dog. Don't do that, I'd think you can be charged criminally for that.

I don't know what is wrong with AC. When I went in to get the report on my dog bite along with all of the other documentation for all the times I have called them on this dog, the guy there told me that my landlord had written a letter saying the neighbor's dog had permission to run free on the property. I asked the guy, since when does a note circumvent the law? He had no answer other than that my landlord can also be held responsible for the dog biting me. They told me that I could call all I want about this dog running loose but they would not be coming back out to the house for the dog running loose. Our government at work.

Do you live on secluded property or is AC prepaired to tell all your neighbors that? I'd have asked them to write that info in their report.

I rent a house on a farm. Landlords house and one other rental property on his land. Dog owners live just on other side of road that runs through property.

I hope you win this case! I have had that happen to my pomeranian in our yard and she survived..how i do not know. I believe the little leather collar stopped the tooth from getting the juggular vein. she was tore up bad. The pit bull broke her off her leash and they both went over the car and it was terrible! I will never forget the sounds of it , the sight of it, or how i felt! prayers for you and puppy!

You really are a smidge unstable aren't you? :crazy: So is everyone else in here who thinks the solution is to sneak off with the dog and put a bullet in its head. The problem isn't the dog, it is the owner. You could kill a million dogs and it wouldn't solve the problem. There is nothing stopping that owner from going out and getting another dog that they can't, or won't control. :shrug:

I wish you luck there. The owner responsible for the death of my horse went right back out and got another dog and there was nothing the county could do to stop him.
