If he has custody of your baby... Why in the world do you want to stop the money? Are you a vindictive, angry Ex?

If child support was such a huge issue in the past you would have taken care of it! Don't let your spawn pay for your past mistakes now.

YOU NEED TO REGAIN CUSTODY OF YOUR SON

talk to an attorney about the SSI and child support question.

Then stay the hell away from the losers

OK --- I'm obviously a failure, which is obvious by my "history".

My QUESTION is, does anybody know if he is entitled to both child support AND social security. I don't have a problem with paying child support, but, if I have to pay, then he owes ME $12,000 in back child support.

Can someone answer my question, and then you all can continue to bash me for my obvious stupidity and irresponsibily.
He is entitled to anything in this world to help him raise your son idiot!

I agree with you 100%. As I stated in my post, I don't have a problem paying more than my fair share, but I want to ensure that the government rules are followed so that, if I do pay child support, that he isn't slapped with a bill from the Government to recoup the child's share of the social security outlay.

GAWWD I hope JPC isn't around. I suspect I opened a can o' worms. sorry.

Can o' worms opened!

I do not understand the winey babies complaining about child support.
Try to raise them on your own.

The expense and the time constraints are worth all the expense, but if you can stay married, keep your commitments and raise your kids, the rewards are so much better than a nasty spouse. JMHO

First off you need to go see a good lawyer and quick.
Then check out the Social security web site.

My understanding is that your son's benefit is almost half of wht his father is receiving as log as there is no other income coming in. If you pay child support, my understanding is that the either they will reduce your son's check or his fathers. This is if he is on regular disability and living with his father. Usually it's one dollar for every two received. If your ex is receiving SSI then my understanding is that only the disabled person can receive a check, but your son living with him can if he is on SSI give your ex a higher food stamp benefit as people with SSI are automatically eligible for food stamp. ( This is what I read).

If your ex has mis used his own check, be assured he doing the same for your son and they child needs out of there in order to be taken care of.

All in all I believe the court will look at the fact that your son gets a check from his fathers disability and no other child support will be required.

 I could ignore you but ...

if the dad gets SSI then SSI is the only exception to child support as SSI receptient does not have to pay,

but if he is on SSDI then the child support can be taken from SSDI.

The SSI pays less to a disabled person and the SSDI pays twice as much. :howdy:

 There is no reason to say or think that the child's father would harm the child.
