Maryland law appears to be a little strange on this subject. It seems that before removing a teacher that it must be recommended by someone from the BOE (even if it is misconduct in office) and then the BOE must give the employee ten days written notice to request a hearing.

And therein lies the biggest problem with the school systems today. A teacher admits guilt to assualting a student and he is still given a special hearing to see if he is still teacher material.

I am all for giving teachers more money and better benifits, but I also think they really need to change the rules on getting rid of teachers. These people are supposed to be role models for our kids. If they are no longer up to that task, then they should not be in the schools anymore.

Offer more money, get rid of the dead wood and our schools can have a chance.

Uh, more importantly, parents don't let students spend the night at teachers' houses, do they? I blame the parents, if we have the whole story here. The teacher has a sickness, of course he's going to invite the kid over. But what parent would let that happen? The teacher is ill, but the parents are obviously retarded.

According to the Enterprise, there is a little more to the story. Apparently, the teacher helped the boy cope with his parents' divorce, when he was in elementary school. The teacher became a role model and mentor to the boy. The teacher had gained the trust of the boy and his parents over the last few years, so I can't blame them for letting him hang out with what appeared to be an upstanding member of the community. Sickos can be good at deluding themselves and others.

Also according to the Enterprise, "McNevitch said he and the boy drank beer together, that the boy kissed his neck and that he kissed the boy's face and neck and rubbed the boy's genitals." In other words, this guy's going to claim the boy started it, he going to claim there were extenuating circumstances. The BOE cannot fire him outright because what if the jury is all on crack that day and actually aquit him? Then he'll sue the BOE for wrongful termination.

McNevitch said he and the boy drank beer together
That would be contributing to the delinquency of a minor, even without the sex. That alone should get him terminated.

He has already admitted his guilt, and since the kid is 15 then at the least he should be found guilty under MS state law § 3-307. Sexual offense in the third degree.

(a) Prohibited.- A person may not:

(4) engage in a sexual act with another if the victim is 14 or 15 years old, and the person performing the sexual act is at least 21 years old; or

(b) Penalty.- A person who violates this section is guilty of the felony of sexual offense in the third degree and on conviction is subject to imprisonment not exceeding 10 years.

and since the guy has been teaching for 10 years, ya gotta figure he is older then 21.

Sorry about that chief.
One thing about this makes me wonder. If Carver is a grade school how was he involved with a 15 year old?

Hello? Teachers typically don't invite students to spend the night and kids typically wouldn't want to anyway.

As a parent, if a teacher ever asked one of my children to spend the night I would immediately be suspicious, and of course, say "no."

Boy we have come a long way from when I was a kid. I used to babysit for some of my teachers, had some of them drive me home afterwards, used to go over to their houses and say hi when I was out and about in their neighborhoods. Used to go inside their homes and have milk and cookies. Used to be tutored afterschool in my Latin teachers house. I went on Honor Society trips with teachers. I was never molested by a teacher. And the thought would have never even crossed my parents minds that it wasn't okay for me to do this. And now this is something that you have to worry about with your children. This is a real shame.

I'm glad you said that Mig - My kids babysit for some of their teachers and their bus drivers. I don't know why this boy was with his teacher, but I'm not ready to point fingers at the parents. :frown:

I won't ask how old you are, but myself at 32 went through pretty much the same as above, with the exception of "used to go over to their houses". Fundamentally, if you analyze the profession of an educator, there is NO REASON a child should be anywhere near a teacher's home, back then or now. Remember, back in the day, waaaay back, teachers never even spoke to pupils outside of the classroom.

Yea but back in the good ole days, in my ole 'hood, I went to church with these people, my father was the town sheriff, I played with their kids, and I sold them girl scout cookies. And maybe your teachers never spoke to you - but I grew up in the South, everybody talks to everybody else.

Hmmmmmmm, [pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause][pause], interesting, that fvcks all kind of things up. As Bugs or Daffy or Porky or someone used to say, "what a predicament"....

"Sickos can be good at deluding themselves and others."

Sure, but in this case I think what would be more appropriate is that sickos are good at deluding other sickos.

"Also according to the Enterprise, "McNevitch said he and the boy drank beer together, that the boy kissed his neck and that he kissed the boy's face and neck and rubbed the boy's genitals." Doesn't matter, at the least he'll get statuatory (sp?) rape or statuatory fondling or whatever they call it.

"The BOE cannot fire him outright because what if the jury is all on crack that day and actually aquit him? Then he'll sue the BOE for wrongful termination."

Huh?

I certainly cannot argue with you or Kain, but that's not the way it worked in suburban DC. The only outside contact I ever had with a teacher was playing poker with Mr. Reinhart in his classroom on Friday after school afternoons, and another teacher picking me up walking from the subway to school. That's it. I'm sure however that you southerners and smalltowners would agree that the "no contact" philosophy is probably more appropriate in today's times, especially under the recent circumstances of psycho priests, teachers, kidnappers and the plain ole' run of the mill lunies. Correct?

Again, I am putting the blame on the parents.
