Property is often impounded for the duration of an investigation, then returned to its rightful owner. It is rarely "seized" and only then for certain serious felonies, and after due process. The state would have to prove the owner was the person actually operating the vehicle at that time in order to seize it. Not an easy task.aps45819 said:Property is frequently siezed if it's "used in the commision of a crime". Wouldn't the dash camera provide enough evidence that the bike was used in the commission of a crime in order to sieze the property?
