Biden Admin Urges Supreme Court to Rule in Favor of Government Elites Censoring Speech of the Misguided Serfs

The Biden administration pushed the US Supreme Court to honor the infinite wisdom of the Washington DC elites in their amicus brief filed on Monday.

The Biden administration wants the Supreme Court to rule in favor of their right to control speech in America today.

We are truly dealing with evil people here.

The Daily Caller reported:

President Joe Biden’s administration in a Monday amicus brief pushed the Supreme Court to rule against Republican-led states’ laws that prevent online censorship.
Florida and Texas have enacted laws to stop Big Tech platforms from censoring content due to viewpoint, and the Biden administration asked for the Supreme Court to review them, according to the brief. Specifically, the Biden administration requested for the Supreme Court to rule against the states’ laws and in favor of social media companies’ right to censor.
“The platforms’ content-moderation activities are protected by the First Amendment,” U.S. Solicitor General Elizabeth Prelogar wrote in the Biden administration’s brief. “Given the torrent of content created on the platforms, one of their central functions is to make choices about which content will be displayed to which users, in which form and which order.”
Florida’s bill prohibits social media platforms from “willfully deplatform[ing] a candidate” for public office and enables Florida to fine a platform $250,000 per day, according to the brief. Texas’ bill broadly blocks platforms with more than 50 million monthly American users from engaging in viewpoint censorship, according to the brief.
The bills are similar but not the same, and the brief requests the Supreme Court to hear cases on both laws.
Western District of Louisiana Judge Terry A. Doughty granted a broad injunction preventing the Biden administration from colluding with social media companies to censor content in the free speech lawsuit Missouri v. Biden in July.

DHS Mayorkas: Cubans ‘Deserve the Right’ to Migrate to U.S.

“Cubans, like my own family, who nearly 63 years ago fled the communist takeover, deserve the same opportunity to follow legal pathways to build a new life in the United States,” said a statement from border chief Alejandro Mayorkas.

The statement announced the opening of a “Field Office” in Havana to help migrants get into the United States via chain migration paperwork, family reunification claims, refugee status, and supposedly “lawful … pathways.”

Mayorkas is a pro-migration zealot, and has frequently argued that “equity” forbids Americans from excluding foreigners who want to live in the United States. He is pushing that open-borders policy despite the established, legitimate, and popular immigration laws that protect ordinary Americans from investors’ use of wage-cutting foreign labor.

Since 2020, more than 350,000 young Cubans have already moved into the United States, often via Nicaragua and Mexico. The new office will help import another 20,000 migrants per year — including many older Cubans who will rely on government-funded healthcare programs and housing that are also needed by Americans.

Biden Air Force Nominee Claimed ‘White Colonels’ Are The ‘Biggest Barriers’ To Change In The Military

On Thursday, The Daily Signal’s Rob Bluey reported that Col. Benjamin Jonsson, who is “currently awaiting promotion to brigadier general,” penned an article in the Air Force Times weeks after George Floyd’s death lamenting his fellow white airmen don’t go along with leftist talking points about so-called “racial injustice” in the U.S. armed forces.

“As white colonels, you and I are the biggest barriers to change if we do not personally address racial injustice in our Air Force. Defensiveness is a predictable response by white people to any discussion of racial injustice. White colonels are no exception,” Jonsson wrote. “We are largely blind to institutional racism, and we take offense to any suggestion that our system advantaged us at the expense of others.”

Jonsson went on claim he “drew attention” to the notion that “racial tension remains an important issue to address” while speaking with two white colonels. According to Jonsson, his “introduction of race into the conversation created social discomfort,” allegedly causing both service members to “ameliorate” the situation “with humor.” He furthermore admonished a fellow white colonel who purportedly expressed the meritocratic sentiment that “when anyone joins the Air Force, they need to adopt the culture of the Air Force [and] that [the branch] should not make cultural accommodations.”

Biden Admin Directs $1.4 Billion into New Covid Research, Vaccines, and Therapies

Clearly, the Biden administration is ramping up to make its COVID response the centerpiece of its 2024 campaign.

I guess the Maui wildfire sympathy tour is not cutting it. Distractions are needed.

So, Biden’s Health and Human Services has directed $1.4 billion in funding for new COVID research, vaccines, and therapies.

Today, the U.S. Department of Health and Human Services (HHS), through the Administration for Strategic Preparedness and Response (ASPR), awarded more than $1.4 billion for Project NextGen to support the development of a new generation of tools and technologies to protect against COVID-19 for years to come.
The awards announced today follow extensive coordination with industry partners and include support for clinical trials that will enable the rapid development of even more effective and longer-lasting coronavirus vaccines, a new monoclonal antibody, and transformative technologies to streamline manufacturing processes.
“Project NextGen is a key part of the Biden-Harris Administration’s commitment to keeping people safe from COVID-19 variants,” said HHS Secretary Xavier Becerra. “These awards are a catalyst for the program – kickstarting efforts to more quickly develop vaccines and continue to ensure availability of effective treatments.”

I would also like to note that Project NextGen is a $5 billion behemoth led by ASPR’s Biomedical Advanced Research and Development Authority (BARDA) in partnership with the National Institute of Allergy and Infectious Diseases (NIAID). You may recall my recent post on the new director of NIAID, Dr. Jeanne Marrazzo, who is the mask-pushing, lab-leak-denying, vaccine-embracing, diversity choice of the medical-bureaucratic complex to replace Dr. Anthony Fauci.

Much of the money is going to COVID-19 vaccine development, despite the fact that basically, everyone has had COVID-19, and new variants will continue to rise in cycles reminiscent of colds and flu viruses.

  • $1 billion for four Phase IIb clinical trial studies on a COVID-19 vaccine. That funding will go to ICON Government and Public Health Solutions, Inc. of Hinckley, Ohio; Pharm-Olam, LLC, of Houston, Texas; Technical Resources International (TRI) Inc., of Bethesda, Maryland; and Rho Federal Systems Inc., Durham, North Carolina.
  • $326 million to Regeneron for a monoclonal antibody to prevent COVID-19.
  • $100 million to Global Health Investment Corp., a nonprofit organization that is managing an investment portfolio known as BARDA Ventures, referring to the federal agency called Biomedical Advanced Research and Development Authority. The portfolio should “expand investments in new technologies that will accelerate responses in the future,” according to a statement from HHS.

Feds Hit SpaceX for Hiring Americans Over Migrants

President Joe Biden’s deputies are “bullying employers who are trying to do the right thing — avoid hiring illegal workers — and are ignoring employers who are flagrantly discriminating against Americans,” said Jessica Vaughan, the policy director at the Center for Immigration Studies.

“They’re working harder to give illegal aliens access to jobs than they are to give to protect Americans’ access to jobs,” she said, adding,”This is entirely consistent with the approach of the Biden administration to tip the playing field in the favor of workers from abroad so that American workers are always going uphill.”

Biden’s deputies defended the lawsuit. “We will hold SpaceX accountable for its illegal employment practices and seek relief that allows asylees and refugees to fairly compete for job opportunities and contribute their talents to SpaceX’s workforce,” said a statement from the radical progressive Assistant Attorney General, Kristen Clarke.

The agency’s lawsuit asks the judge to favor migrants over better-qualified Americans, by “Order[ing] SpaceX to hire [foreign] applicants who were victims of the discriminatory practices alleged in this Complaint and were qualified for employment.”

Federal law says hiring managers cannot unfairly exclude legal migrants who have been given asylum or refugee status by government agencies. In practice, that legal status is rare because it is short-lived and is quickly converted into green cards and then into citizenship.

The company only hired one such person from 2018 to 2022, says the lawsuit:

According to data SpaceX provided to the federal government, from September 2018 to May 2022, out of more than 10,000 hires, SpaceX hired only one individual who was an asylee and identified as such in his application. SpaceX hired this asylee approximately four months after IER notified the company of its investigation. From September 2018 to May 2022, SpaceX did not hire any individuals who were refugees and identified as such in their applications.

The complaint cited a tweet from SpaceX owner Elon Musk:

On June 16, 2020, SpaceX’s CEO, who then had approximately 36 million followers on X, a social media platform formerly known as Twitter, posted, “U.S. law requires at least a green card to be hired at SpaceX, as rockets are advanced weapons technology.”

American companies need to be very careful about workers’ legal status and about forged documents, especially in high-tech jobs where small mistakes can have large costs, and in industrial jobs where small mistakes can kill or injure Americans, said Vaughan

“It used to be that these [federal discrimination] cases were handled with counseling,” said Vaughan. But Biden’s officials are trying to “intimidate employers into not asking questions and just accepting what the alien provides in terms of [possibly forged] documentation and to just look the other way.”

However, the Biden-run department only gives wrist-slaps to companies that discriminate against competent and honest Americans, Vaughan said.

In August 2022, the DOJ fined a Texas company $4,250 for importing visa workers instead of hiring qualified American workers. The company also to to pay $14,1164 in back pay. In May, the agency announced a tiny $3,855 settlement with a U.S.-based company that excluded Americans from technology jobs.

Another company was fined $25,000 for anti-American discrimination in six jobs. In July 2022, the Department imposed a fine of only $12,000 on a Virginia-based company named Technology Hub Inc.. for excluding Americans from white-collar jobs.

Biden Admin Honors ‘Chestfeeding Month,’ No Half-Staff Flag Order for Maui Fire Victims

U.S. Customs and Border Protection

The source says the message received by employees may seem benign to some as the agency has supported lactation services for mothers returning to work after delivery for years. However, DHS has added “chestfeeding” to the annual messaging campaign to appease the left. The term accommodates mostly transgender males who prefer the word chest over the traditional vernacular. The source says that the Secretary of Homeland Security, Alejandro Mayorkas, focuses on woke efforts to rename awareness campaigns, but he is keeping employees in the dark on the agency’s efforts regarding the relief and mobilization to the Lahaina wildfire.

“We can get the messaging on ‘Breast/Chestfeeding Awareness Month,’ we can get policy editing that refers to pregnant employees and migrants as ‘pregnant persons,’ what we don’t get is a flag action notification to honor the more than 100 people, and perhaps hundreds more that perished in this tragedy,” the source told Breitbart Texas. The source offered no explanation regarding why the awareness month’s name was changed to add “chestfeeding” by the agency.

“Certainly, it was not changed by the United States Breastfeeding Committee,” the source stated. “It’s all just symbolism and a distraction from the mission.”

Biden-Appointed Judge Rules Maryland Parents Have No Right to Opt Their Children Out of Woke LGBTQ Curriculum

In a press release, Becket explained, “The new ‘inclusivity’ books were announced last fall for students in pre-K through fifth grade. However, instead of focusing on basic principles of respect and kindness, the books champion controversial ideology around gender and sexuality. For example, one book tasks three and four-year-olds to search for images from a word list that includes ‘intersex flag,’ ‘drag queen,’ ‘underwear,’ ‘leather,’ and the name of a celebrated LGBTQ activist and sex worker. Another book advocates a child-knows-best approach to gender transitioning, telling students that a decision to transition doesn’t have to ‘make sense’; teachers are instructed to say doctors only ‘guess’ when identifying a newborn’s sex anyway. Other books focus on children’s romantic feelings.”

“The School Board revoked notice and opt-outs for these storybooks earlier this year, contrary to Maryland law and the Board’s policies,” the law firm added. “Even the Board’s elementary school principals protested that the books were age-inappropriate, dismissive of students’ religious beliefs, and present as facts information that is not factual.”

Judge Boardman rejected the arguments, claiming in her ruling that “the plaintiffs’ asserted due process right to direct their children’s upbringing by opting out of a public-school curriculum that conflicts with their religious views is not a fundamental right.”

“Because the plaintiffs have not established any of their claims is likely to succeed on the merits, the Court need not address the remaining preliminary injunction factors,” Judge Boardman added. “Nonetheless, because a constitutional violation is not likely or imminent, it follows that the plaintiffs are not likely to suffer imminent irreparable harm, and the balance of the equities and the public interest favor denying an injunction to avoid undermining the School Board’s legitimate interests in the no-opt-out policy . . . The plaintiffs seek the same relief pending appeal as in their preliminary injunction motion: an injunction that requires the Board to provide advance notice and opt-outs from instruction involving the storybooks and family life and human sexuality. For the reasons stated in this opinion, the Court cannot conclude the plaintiffs are likely to succeed on the merits of an appeal. The plaintiffs’ request for a preliminary injunction pending appeal is denied.”

Becket has vowed to continue the fight, bringing the case to the Fourth Circuit Court of Appeals.

Justice Department Sues Elon Musk for Not Hiring Illegal Immigrants and Asylum Seekers

DoJ says that Space X wrongly claimed in its advertisements and online postings that the company could only hire U.S. citizens and green card holders because of export control laws.

The lawsuit pointed to a Twitter post by Musk claiming that “U.S. law requires at least a green card to be hired at SpaceX, as rockets are advanced weapons technology.”

Musk is accusing DoJ and by extension, the Biden administration of the “weaponization of the DOJ for political purposes.”

Reuters:

In a post on X, the SpaceX CEO said the company “was told repeatedly that hiring anyone who was not a permanent resident of the United States would violate international arms trafficking law, which would be a criminal offense.”
U.S. Assistant Attorney General Kristen Clarke of the Justice Department’s civil rights division said a DOJ investigation found that SpaceX “failed to fairly consider or hire asylees and refugees because of their citizenship status and imposed what amounted to a ban on their hire regardless of their qualification, in violation of federal law”.
Clarke also said SpaceX recruiters and high-level officials “actively discouraged” asylum recipients and refugees from seeking work opportunities at the company.

Doj wants back wages and fair consideration for asylum recipients and refugees who were denied employment at Space X. The would be a fairly large number because any immigrant or asylum seeker who applied for a position at Space X would be in line to receive compensation.

Politico:

According to the complaint, Musk also said in a video from an international space conference in 2016 that “unless [you] can somehow get a green card, we are legally prevented from hiring anyone.”
The Justice Department is asking an administrative law judge to order SpaceX to stop the allegedly illegal hiring practice, pay an unspecified civil penalty, consider hiring applicants and potential applicants impacted by the policy and provide back pay to those affected.
The complaint notes that SpaceX hired for numerous positions with no connection to sensitive technology, like cooks, dishwashers and baristas. It’s unclear whether the Justice Department is claiming the firm turned away applicants for such jobs because they didn’t have a green card — the permit the U.S. government issues to lawful permanent residents.

White House Counsel’s Office Met With Top Aide For Jack Smith, FBI Agent Weeks Before Trump Indictment: Report

“There is no legitimate purpose for a line [DOJ] guy to be meeting with the White House except if it’s coordinated by the highest levels,” Giuliani said, according to the New York Post.

“What’s happening is they have trashed every ethical rule that exists and they have created a state police. It is a Biden state prosecutor and a Biden state police,” the former New York City mayor added.

Trump pleaded not guilty to 40 counts relating to his handling of classified documents that were seized during an FBI raid of Trump’s Mar-a-Lago estate in Palm Beach, Florida. Bratt reportedly visited the estate in June 2022, two months before the raid, and interacted with Trump. Bratt then pushed for a warrant for the unannounced raid on Trump’s property, according to The Washington Post. According to the report, Bratt’s temper flared during the meeting when he told FBI agents that they could no longer trust the former president or his lawyers.

Smith also indicted Trump on additional felony charges for his alleged role in seeking to overturn the 2020 presidential election, pointing to the January 6, 2021, Capitol riot as an “unprecedented assault on the seat of American democracy.” Smith was appointed special counsel in both the classified documents case and the 2020 election case by Attorney General Merrick Garland.

George Washington University law professor Jonathan Turley told the New York Post that the meeting between Bratt, the White House, and the FBI “raises obvious concerns about visits to the White House after [Bratt] began his work with the special counsel.”

Mystery land buyers around California Air Force base revealed

Despite early speculation China was behind the purchases — amid concerns that companies with ties to China have been ramping up efforts to buy American farmland — legal representation for Flannery has maintained the group is controlled by U.S. citizens, with 97% of its capital coming from U.S.-based investors.

However, after eight months of investigation, federal officials were not able to confirm or deny this to be true and were not able to determine exactly who was backing the company.

Now, reports from The New York Times and San Francisco Chronicle reveal Flannery is comprised of a group of ultra-wealthy Silicon Valley investors acquiring vast parcels of land northeast of San Francisco with the mission to build a new California city “from scratch.”

According to the reports, the investors’ plan for the land involves creating a new urban center that could accommodate the growing demands of the tech industry and provide a fresh environment for innovation and economic growth.

It was the “third fire to hit the plant in less than a year.” That’s not weird at all. Happens all the time, right? Maybe they need to hire a new fire safety chief or something. Just saying.

Diesel prices jumped by +5%, and gasoline futures are up about +4% on the news.

HHS Reveals First 10 Drugs for Medicare Price Setting

Healthcare, Prescription Drugs, Costs, Inflation Reduction Act, Public Health

AllSides Summary

On Tuesday, the Centers for Medicare and Medicaid Services (CMS) at the U.S. Department of Health and Human Services (HHS) announced the first ten drugs that will be subject to Medicare price negotiation, as authorized under the Inflation Reduction Act.

Key Details: The ten drugs include: Eliquis; Jardiance; Xarelto; Januvia; Farxiga; Entresto; Enbrel; Imbruvica; Stelara; and Fiasp. The negotiations will take place over 2023 and 2024. Additional drugs from the doctor-administered Part B program and Medicare Part D will be selected in upcoming years.

Key Quote: “For far too long, Americans have paid more for prescription drugs than any major economy. And while the pharmaceutical industry makes record profits, millions of Americans are forced to choose between paying for medications they need to live or paying for food, rent and other basic necessities,” President Joe Biden said. “Those days are ending.”

For Context: The drugs were chosen based on their eligibility under the Inflation Reduction Act. They are the "highest total Part D gross covered prescription drug costs" under Medicare Part D, and account for $50.5 billion in Part D costs.

How the Media Covered it: Some right-rated outlets noted that the initial list of drugs could spark debate over possible exclusions. Some left-rated sources suggested the drug industry and its allies may find a way to block price-setting negotiations.

Boosters, fencers, and cleaners: Inside cartels' newest criminal enterprise of organized retail theft

A nationwide retail theft epidemic cost the United States close to $100 billion in 2021. Stores are being forced to raise prices or shut up shop, insurers are refusing to help, and smaller mom and pop stores are being left behind. In this series, Mayhem on Main Street, the Washington Examiner will investigate the causes behind the scourge of shoplifting, the role of the cartels, the cost to stores big and small, and the complicity of lax prosecutors. Part 2 investigates the role of the cartels. To read Part 1, click here.

Mexican cartels are behind the spike in organized retail crime and are deeply entrenched in every level of the process, according to the federal government's chief investigative agency.

Retailers nationwide sustained nearly $100 billion worth of losses in 2021, the highest year on record, according to the National Retail Federation report published in September 2022. The growing number of cartel-run theft rings around the country drove that figure up from $70 billion in 2019.

"Organized retail crime is leading to more brazen and more violent attacks in retail stores throughout the country. Many of the criminal rings orchestrating these thefts are also involved in other serious criminal activity such as human trafficking, narcotics trafficking, weapon trafficking, and more," said Steve Francis, acting executive associate director for Homeland Security Investigations, in a statement. HSI is part of the Department of Homeland Security's Immigration and Customs Enforcement.

Federal authorities have been probing roughly 5,000 pilots suspected of withholding major health issues that could imperil their ability to fly safely, report says

Federal authorities have been probing roughly 5,000 pilots who officials believe may have falsified their medical records to hide that they were earning benefits for significant health issues that could imperil their ability to fly safely, The Washington Post reported.

The pilots who have had their records examined are military veterans who informed the Federal Aviation Administration that they were suitable to fly, but didn't disclose that they were also receiving veterans benefits for various disabilities that could prevent them from effectively sitting in a pilot's seat.

Veterans Affairs investigators stumbled on the record inconsistencies over two years ago, but the FAA had not publicly disclosed many aspects of the investigation, according to The Post.

FAA spokesman Matthew Lehner told The Post that the agency had been probing around 4,800 pilots "who might have submitted incorrect or false information as part of their medical applications" and indicated that roughly half of the cases were closed. The spokesman also said 60 pilots who "posed a clear danger to aviation safety" were — for the moment — barred from the cockpit while their records were being looked over by officials.

Migrant Mother Dies in Biden Admin Detention Cell near Border in Texas

U.S. Customs and Border Protection officials are investigating the in-custody death of a Honduran migrant woman who died from as-yet-unknown causes less than one day after she crossed into the United States from Mexico. Officials claim the woman had no apparent illnesses or medical conditions at multiple medical screenings during her time in custody.

During this period, Border Patrol officials averaged approximately 20,000 migrants in custody each day, according to a source within CBP. Officials do not discuss the overcrowding in the official statement released on September 1. The massive increase in Family Unit apprehensions in recent months adds to the processing time in these already overcrowded facilities, Breitbart Texas’ Randy Clark reported. In July, agents apprehended 60,000 migrant families — nearly doubling June’s total of 31,266. By the end of August, that number jumped to more than 91,000.

300 Migrants Stroll Across Biden Admin’s ‘Closed’ Border into Arizona on Labor Day

The large group consisted of migrants from a host of different countries including Venezuela, Nicaragua, the Peoples Republic of China, and the Islamic Republic of Mauritania.

According to a source within CBP, not authorized to speak to the media, the Lukeville area is one of the busiest crossing points in the Tucson Border Patrol sector for migrants from outside our hemisphere. These are labeled by the Department of Homeland Security Special Interest Aliens and include those from China and Mauritania. The migrants in Monday’s large group were detained by the Border Patrol at a rallying point on Puerto Blanco Drive near the Lukeville Port of Entry leading into Sonoyta, Mexico.

Breitbart Texas observed heavily armed Mexican National Guard soldiers and State Police patrolling the border fence along the southern side of the border. The soldiers and law enforcement officers appear to be having little impact on the number of migrants crossing into the United States, according to Border Patrol agents in the area.

The CBP source says flood gates in the border wall, opened annually due to the monsoon season, allow the migrants to walk freely into the United States with little resistance. Those gates will be welded shut soon as the season normally ends in mid-September. The source says the problem of migrant crossings in the area will not end once the gates are shut as migrant smugglers often cut the gates open or breach the border wall in other areas daily.

Breitbart Texas observed trash and debris on both sides of the border wall at one of the heaviest migrant crossing areas. In Mexico, the debris incudes discarded identity documents purposely left behind by the migrants as they enter the United States. Often, travel documents issued by Mexico’s National Institute of Migration are left behind to conceal the migrant’s travel pattern and identity according to the CBP source.

Biden’s labor board wants to trap workers in unions they oppose

President Biden, who campaigned on being “the most pro-union president in American history” and is counting on Big Labor’s multi-billion-dollar political machine again in 2024, is unleashing his administration to the benefit of his favorite special interest.

The National Labor Relations Board (NLRB), stocked with Biden appointees and former union lawyers, has been busy doing just that. If workers won’t voluntarily vote unions in, Biden’s NLRB, whose rules cover most private sector workers, wants to take their vote away.

That’s why the NLRB, at the end of August, effectively mandated the “card check” unionization process by bureaucratic fiat. Never mind that numerous union-backed measures in Congress to require this abuse-prone unionization process have failed to pass into law.

Card-check drives occur when employers, usually in the face of union-applied political and economic pressure, waive workers’ right to a secret ballot election. During these drives, union officials are allowed to demand union authorization cards directly from workers using coercive tactics that would be unlawful during a secret ballot vote.

Union organizers can show up at workers’ homes over and over again demanding signatures, in some instances requiring workers to call the police to get organizers to leave. Workers report being misled about the true implications of signing the cards, and some have been told they would be fired if they didn’t sign just before the union successfully took over.

Some workers even face threats of violence. In one SEIU organizing drive, a worker reported being told that the union would “come and get her children” and “slash her tires” if she didn’t sign a union card.

By its very nature, card check-makes it impossible to keep one’s views on unionization private, a dangerous liability in the often heated environment of a union organizing drive.

The Biden NLRB’s moves to rig the rules to favor union bosses don’t stop there. Any day now, the Biden majority on the Board, which includes two former Service Employees International Union (SEIU) lawyers, is expected to finalize rulemaking to undo the 2020 “Election Protection Rule” and further restrict workers’ right to hold votes to remove unions they no longer want representing them.

In overturning the 2020 rule, Biden’s NLRB is trying to block workers from holding “decertification” votes, which strip undesired unions of their power to impose their representation upon all workers in a bargaining unit. This is a priority for Big Labor because in recent years the NLRB has seen double-digit increases in the number of worker-backed decertification petitions.
