Need Help from parents

:howdy: Thanks for the overwhelming support, I am going have to go back and reread all your posts, and act on all the info you have given me.

as soon as I finish posting in here, I will be contacting the numbers you have given.

answers to a few questions, yes, I am in the military, I have been to navy legal and they can only give me advice and point me in the right direction but cannot represent me in town.

the original divorce decree and custody were determined in hawaii, but since she has been living in MD I'm told that MD has jurisdiction. I contacted the social worker in hawaii that originally recommended that I be granted custody because of suspected illegal activity by the mother and he said he was going to look into it as well.

originally, she was granted custody because I am in the military and deployable, but now I am in an undeployable status and I will be rotating to shore duty soon.....

again thank you all for the info and thanks to MD for having public records!!! I am a few hours behind you all, but if I'm not in here following leads, I'm on the phone trying to "hit hard with overwhelming force!"

HEHE! Thanks Pete and APS for the wonderful info, I have had this info for a few days now and I've been exhausting all my resources here and felt like I was getting nowhere, I was kinda hesitant to post this in here, but I'm thankful that I did. I'll be back later to update you guys.

OK, since Hawaii is the origin of the judgement you are stuck fighting this out in Maryland.

You need to get every scrap of paper documenting her illegal behavior even if it is only alleged from Hawaii. Also the reccomendation of the social worker and a sworn statement would be nice as well.

Next contact a lawyer here and get to work filing for an urgent temporary custody hearing. Get the certified copy of the divorce from Hawaii. File for the temporary custody hearing and get all you can on her arrest here.

Typically they will schedule an emergency hearing rather quickly, especially since she could be going to jail soon. Once the temporary hearing is done they will schedule a regular hearing to hear both sides. You will have to come here for both the temp hearing and the regular hearing.

Once you win custody in both of those you will on your way to being super dad.

ARGH!! I feel like I spent all day chasing things down, but I still don't feel like I've gotten a hold of the right people.

Dugan: no longer practices in child custody, but I was referred to a couple others, one of which was highly recomennded through a PM.

Investigator Morris: Has been retired for quite some time. I went ahead and explained my story several times to numerous people and shuffled around from extension to extension, the best I got was to write the district court a letter stating my concerns and hopefully they take that into consideration at the criminal hearing. Otherwise it was a resounding GET A LAWYER!

CPS: was called as soon as I found out, but they were reluctant to look into it because there is no proof that the child was with her at the time. I was like "Mam, with the seriousness of these charges, whether or not my child was there, he is still in danger." So I am unsure of where that is going.

ST. Mary's Sherriff: Were the only ones that actually pulled the file, but also suggested I get a lawyer. And they would be happy to accompany me to go get the child once the order was modified, but couldn't point me in the right direction to take action.

So, basically, I'm waiting, hopefully the lawyer is able to contact me soon and hopefully then they will start getting results.

What the hell is up with that??? So the kid actually has to be present when the parent is arrested for drugs, or they don't consider that a danger?????

Good luck, Dad - I can't believe this isn't a cut and dried case of, "Yeah, come get your kid." :ohwell:

Write the letter to the DA, keep on CPS and force them to investigate, when you get custody take the sheriff's offer to get the child, hound the lawyer and Fedex his retainer.

The theme right now is to strike as fast as you can while the criminal case it swirling. Go to Navy relief for assistance in airfare and retainer money for the lawyer if possible. The base here has a nice BEQ to stay at while you are here for hearings.

Exercise your rights as a DAD! A heroine addict is no place for a kid.

The good thing is ST Mary's is still rural and not clogged with horrible cases of neglect and crime that desensitize county officials. I believe that if the facts are as they seem it will be virtually automatic change of custody.

As far as CPS acting it is hit or miss. The way it was explained to me if the child is not in imminent danger IE: Crawling on the floor around used needles, the bar for proving neglect is quite high.

FAX your letter to the DA now and then follow it up with a certified return receipt; same goes with CPS and like Pete said, keep calling them.

You need a lawyer now or can you consult with an attorney via phone? (don't know about that either)...I'm a little baffled as to why you are not getting legal assistance from the Navy but don't have enough knowledge in that to comment. Call the referrals you got from Dugan's office.

The Navy legal office doesn't deal with civil law.

Wow! PETE, you are the man!! I have been so consumed with this, I didn't even think of going to navy relief for assistance, I'm also going to see if I can get a hold of my old roommate that is now stationed in PAX, that may ease up the finances. I know you're probably getting tired of me thanking you, but THANK YOU!

Been there, done that. Single dad now 9 years. First 5 while I was in the Navy. Fought all the way and even when the lawyers said probability is low I started looking up the law myself and forcing them to act.

BTW, when you do the motion for custody don't forget to jam some child support up her ass.

I've been able to talk to my son through the ex, I have called a couple of times, with this info burning a hole in me and I just talked to my son like nothing is wrong and everything is normal. I don't think she has a clue yet that I know what I know.

Keep it that way! Ignorance is the greatest weapon you have. Even if CPS agrees to investigate they cannot tell her who made the report. Keep acting like you do not know. The first time she see's you should be in the court room for the hearing.

Also if you have a home phone go to radio shack and get a cheapo tape recorder and a line tap. Cost about $30. Record your phone calls with the child and her. IF by some chance she finds out what you are up to and kirks out you record it and bring the tape to court.
